Lawther, Usher, <br /> RESOLUTION NO.~ 4199 BY: Ward, Wendling, <br /> Williamson, <br /> Gaydos, Huffman. <br /> AN EF~RGENCYRESOLUTION authorizing payment of a mo~ai <br />claim in the amount of $194~68 to Kevin J. Loftus. <br /> <br /> WHEREAS, On July 25, 1962, a police cruiser collided <br />with a 1960 Dodge automobile, pushing it forward into the rear <br />of a 1958 Cadillac sedan owned by Kevin J. Loftus, while both <br />vehicles were being operated on Detroit Avenue in the vicinity <br />of Bunts Road, Lakewood, Ohio, and, <br /> <br /> WHEREAS, Under the provisions of Section 701~02 of the <br />Ohio Revised Code, the City of Lakew0o~ is not legally liable for <br />such damage, and, <br /> <br /> WHEREAS, This Council has determined that it has a moral <br />obligation to reimburse Kevin J. Loftus for said damage, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he is <br />hereby authorized to pay to Kevin J. Loftus the sum of $194.68, <br />for the cost of repair of damage to a 1958 Cadillac sedan, inflicted <br />by a police cruiser of the City of Lakewood, on July 25, 1962. <br /> <br /> Section 2. This resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: January 21, 1963 <br />Robert M.
