RESOLUTION NO. 3208 BY: <br /> <br />Messrs. Wendling, Gaydos, <br /> Huffman, Lawther, <br /> Usher, Ward. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public <br />Works to enter into a contract with Cuyahoga County, Ohio, for <br />the privilege of utilizing the City Hall as a civil defense <br />fall-out shelter. <br /> <br /> WHEREAS, The President of the United States has undertaken <br />for the Nation an accelerated and strengthened civil defense <br />program including a fall-out shelter program, and, <br /> WHEREAS, Cuyahoga County, Ohio has requested permission to <br />utilize the Lakewood City Hall as a fall-out shelter and, <br /> <br /> WHEREAS, This resolution constitutes an emergency measure <br />providing for the immediate preservation of the public health <br />and safety and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF O~IO: <br /> Section 1. That the Director of Public Works be and he is <br />hereby authorized and directed to enter into a contract with <br />Cuyahoga County, Ohio, such contract to read substantially as <br />follows: <br /> WHEREAS, The President of the United States has undertaken <br /> for the Nation an accelerated and strengthened civil defense <br /> program, including a fallout shelter program; and <br /> WHEREAS, a fallout shelter survey has indicated that certain <br /> areas of the hereinafter described premises will afford persons <br /> protection from the hazard of allout in the event of enemy <br /> attack; <br /> <br /> NOW, THEREFORE: the undersigned, being the owner of the <br /> hereinafter described premises, or the person otherwise <br /> authorized to grant such license or privilege, does hereby <br /> voluntarily andwithout compensation, in consideration of the <br /> mutual promises expressed herein and in cooperation with <br /> the Federal, State, and local civil defense programs for <br /> measures to protect persons against the threat of fallout, <br /> radiation from enemy attack, grant to the ~ederal Government, <br /> the State of Ohio and the political subdivision of Cuyahoga <br /> County, and to the general public for use in accordance with <br /> civil defense shelter plans, the following license or <br /> privilege; <br /> <br /> 1. A. Use of the basements, corridors, and <br /> other common areas of the building, or <br /> structure situated at i2W~0 Detroit Avenue <br /> and known as L~ewood City Hall, as well as <br /> any other common use parts of the said <br /> building or structure which the Federal <br /> Government and the political subdivision shall <br /> determine appropriate, including without <br /> limitation the rights to the public of ingress <br /> <br /> <br />
