RESOLUTION NO. 4242 BY: Messrs. Lawther, Usher, <br /> Ward, Wendling, <br /> Gaydos, Huffman. <br /> AN EMERGENCY RESOLUTION declaring an emergency and <br />authorizing and direc%ing the Director of Public Works to enter <br />into a contract without the statutory formalities of competitive <br />bidding and advertising, for sandblasting, repairing and painting <br />the swimming pool in Lakewood Park° <br /> <br /> ~EREAS, A real and present emergency exists in that <br />the interior of the swimming pool is cracking and peeling, thereby <br />endangering the health and safety of all the citizens of the City <br />of Lakewood, and, <br /> <br /> ~EREAS, The sandblasting, repairing and painting where <br />necessary must be made immediately in order to preserve the public <br />health and safety, and, <br /> <br /> V~EREAS, This resolution constitutes an emergency measure <br />providing for the i~nediate preservation of the public health and <br />safety and for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Council hereby declares that the <br />cracking and peeling of the Lakewood Park swimming pool constitutes <br />a real and present emergency. <br /> <br /> Section 2o That the Council hereby determines to make <br />the necessary repairs by sandblasting, and painting where necessary <br />in the Lakewood Park Swimming Pool, by contract. <br /> <br /> Section 3. That 'the Director of Public Works be and he <br />is hereby authorized and directed to enter into a contract for sand- <br />blasting, repairing anc painting the Lakewood Park swimming pool <br />where necessary, with Protective Coatings, Inc. at an estimated cos~ <br />of $5,873~00, without the necessity of statutory and Charter <br />formalities of competitive bidding and advertising. <br /> <br /> Section 4. This resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Robert M.
