Lawther~ Usher, <br /> RESOLUTION NO. 4271 BY: Ward, Wendling, <br /> Williamson, Gaydos, <br /> Huffman. <br /> AN EMERGENCY RESOLUTION authorizing and directing the Finance <br />Director of the City of Lakewood to accept the principal and inter- <br />est on special assessment levied on permanent parcel No. Bll-7-40 <br />on the Cuyahoga County Auditor's records and authorizing the County <br />Auditor to cancel said special assessment for the years 1963, 1964~ <br />1965 and 1966. <br /> <br /> WHEREAS, the City has special assessment charged against the <br />property hereinafter described and levied under Ordinance NCo 54-61, <br />adopted by the Council of the City of Lakewood on June 5, 1961, and~ <br /> <br /> WHEREAS~ The owner of the said property has tendered payment <br />of the principal portion and interest on the special assessment <br />levied on said parcel pursuant to the provisions of Section 5719.16 <br />of the Revised Code of the State of Ohio, and, <br /> <br /> WHEREAS~ This resolution constitutes an emergency measure <br />providing for the usual daily operation of a municipal department~ <br />now~ therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEW00D, <br />STATE OF CHI0: <br /> <br /> Section 1. That bhe Director of Finance of the City of <br />Lakewood be an~t6he is h?reby authorized and directed to accept the <br />sum of ~~dered in payment of the principal and i~terest for <br />the years 1963 through 1966 of special assessment charged against <br />the property described as p~rmanent parcel No. 311-7-40 on the <br />Auditor's records of Cuyahoga County~ 0hio, and levied under Ordi- <br />nance No. 54-61, adopted by the Council of the City of Lakewood on <br />June 5, 1961. <br /> <br /> Section 2. That said special assessment as hereinbefore set <br />forth having been accepted as set forth in Section 1 hereof, and <br />the Auditor of Cuyahoga County be and he is hereby authorized to <br />cancel said special assessment for the years 1963 through 1966 .~ <br />levied under Ordinance No. 5~-61~ adopted by the Council of the <br />Clty of Lakewood on June 5, 1961 on permanent parcel No. 311-7-40 <br />on the County Auditor's records and further described as being <br />Sublot No. 61 in the Clifton Park Land & Improvement Co. Allotment, <br />each annual assessment being in the amount of $52.94o <br /> <br /> Section 3. That the Clerk of Council be and he is hereby <br />authorized and directed to deliver a certified copy of this reso- <br />lution to the Auditor of Cuyahoga County £~r the purpose of having <br />said special assessment canceled. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof <br />and provided it receives the affirmative vote of two-thirds of all <br />members elected to Council~ it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: September 3, 1963 <br /> <br />Approved: September 5, 1969 <br /> <br />Robert M.
