Messrs. Ward, We~dling, RESOLUTION NOo 4273 BY: Williamson, Gaydos, Huffman, Lawther, Usher. AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood 'to accept the principal and inter- est on special assessment levied on permanent parcel No. 311-7-11 on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1963~ 1964, 1965, 1966 and 1967. WHEREAS~ the City has special assessment charged against the property hereinafter described and levied under Ordinance No. 9-63~ adopted by the Council of the City of Lakewood onMarch 18, 1963, and~ WHEREAS, The owner of the said property has tendered payment of the principal portion and interest on the special assessment levied on said parcel pursuant to the provisions of Section 5719.16 of the Revised Code of the State of Ohio, and~ WHEREAS~ This resolution constitutes an emergency measure providing for the usual daily operation of a municipal department; now~ therefore, BE IT RESOLVED BY T~ COUNCIL OF THE~CITY OF LAKEWOOD~ STATE OF 0HI0: Section 1. That the Director of Finance of the City of Lakewo~d be and he is hereby authorized and directed to accept the sum of $119o45 tendered in payment of the principal and interest for the years I963~ 196~ 1965~ 1966 and 1967 of special assess- ment charged against the property described as permanent parcel No. 311-7-11~on the Auditor's records of Cuyahoga County~ Ohio, and levied under Ordinance No. 9-63, adopted by the Council of the City of Lakewood on March 18~ 1963~ .~ S~ction 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he is hereby authorized to cancel said special assessment for the years1963 through 1967 levied under Ordinance No. 9-63~ adopted by the Council of the City of Lakewood on March 18, 1963 on permanent parcel No° 311-7-11 on the County Auditor's records and further described as being in the Fowler-Worman-Kelley Westhaven Subdivision~ each annual assess- ment being in the amount of $23.89. Section 3. That the Clerk of Council be and he is hereby authorized and direated to deliver a certified copy of this res- olution to the Auditor of Cuyahoga County for the purpose of having said special assessment canceled. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
