Usher, Ward, <br /> RESOLUTION NO. 4278 BY: Wendling, Wllliamson, <br /> Gaydos, Huffman, <br /> Lawther. <br /> AN EMERGENCY RESOLUTION authorizin9 the <br />payment of a moral claim in the amount of $209°44 to the estate <br />of John C. Fesckanino <br /> <br /> WHEREAS, This Council has learned of the death of <br />John Co Fesckanin on July 12, 1963, after, said John C. Fesckanin <br />having served in the Division of Refuse Collection and Disposal, <br />Department of Public Works, since June 25, 1952, and, <br /> <br /> WHEREAS, John Co Fesckanin, at the time of his <br />death, had accrued vacation time unused by him in the stipulated <br />amount of $209.44, and, <br /> <br /> WHEREAS, On August 5, 1963, Council evidenced its <br />intent to pay unused vacation time to employees whose death had <br />so occurred, and, <br /> <br /> WHEREAS, This Council has hereby determined that <br />there is a moral obligation to reimburse the estate of the said <br />John C. Fesckanin, and, <br /> <br /> WHEREAS, This resolution is hereby declared to be an <br />emergency measure providing for the usual daily operation of a muni- <br />cipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he <br />is hereby directed to pay to the estate of John Co Fesckanin, the <br />sum of $209.44, said sum being payment for earned but unused <br />vacation time accruing prior to his death on July 12, 1963~ <br /> <br /> Section 2o That this resolution is hereby declared <br />to be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two-thirds <br />of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: September 16~ 1963 <br /> <br />Robert M.
