AN EMERGENCY RESOLUTION memorializing the Legislature <br />of the State of Ohio. <br /> <br /> WHEREAS, this resolution constitutes an emergenc~ measure <br />providing for the immediate preservation of the public heal!th, <br />property, safety and welfare of the citizens of the City of <br />Lakewood, and, <br /> <br /> WHEREAS, the fixing of speed limits and control of <br />safety standards on City streets is a matter best adminis- <br />tered by local law enforcement officials, and, <br /> <br /> WHEREAS, as a result of a recent Supreme Court decision, <br />the speed limit on certain streets in the City of Lakewood <br />has been arbitrarily raised to 35 miles per hour under the <br />Court's definition of "through streets", and, <br /> <br /> WHEREAS, this condition through which residential streets <br />are converted into through streets by operation of law by <br />virtue of erection of stop signs at intersections with <br />other streets, ~9, ~ ~$~~ <br /> <br /> WHEREAS, this condition is hazardous to life, limb and <br />property of all citizens using these streets and should be <br />corrected by legislative action without delay, and, <br /> <br /> WHEREAS, Senate Bill 78 has been introduced in the Senate <br />of the State of Ohio and has the support of the Ohio Muni- <br />cipal League and law enforcement officials in all parts of <br />the State of Ohio, and, <br /> <br /> WHEREAS, Senate Bill 78 is drafted so as to resolve the <br />problem which has arisen by virtue of the Supreme Court <br />decision, now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. This Council hereby expresses its grave <br />concern over the hazardous situation created with respect <br />to so-called through streets. <br /> <br /> Section 2. This Council urges both branches of the <br />State Legislature to give serious and favorable consider- <br />ation to Senate Bill 78 or other legislation which would <br />correct this problem. <br /> <br /> Section 3. The Clerk of Council is hereby directed to <br />forward ceEtified copies of the Resolution to the Ohio House <br />of Representatives, the Ohio Senate and to the Chairman of <br />the Senate Highways and Motor Vehicles Committee, <br /> <br /> <br />
