RESOLUTION NO. 4403 BY: Messrs. Gaydos, Huffman, <br /> Usher, Ward, <br /> Wendllng, Bennett. <br /> <br /> AN EMERGENCY RESOLUTION declaring the intent of the <br />Council oi the City of Lakewood to vacate the West Extension <br />at the north end of Estill Drive in the City of Lakewood, <br />reserving, however, to the City of Lakewood, easements for <br />ma~tenance and/or reconstruction of water lines, sanitary and <br />storm sewers. <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety and welfare and for the usual daily operation of <br />a municipal department; now, t~erefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF L4%KEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Council of the City of Lakewood <br />hereby declares its intent to vacate the West Extension at the <br />north end of Estill Drive in the City of Lakewood, reserving, <br />however, to the City of Lakewood, easements for maintenance <br />and/or reconstruction of water lines, sanitary and storm sewers, <br />now located in the area intended to be vacated, all as shown <br />on Map No. P 227 C of the Division of Engineering, City of <br />Lakewood, Ohio. <br /> <br /> Section 2o That the Clerk of council shall cause <br />notice of such declaration to be served in the manner that the <br />service of summons is required to be made, upon all persons <br />whose property abuts upon the part of Estill Drive affected by <br />the proposed vacation, and bypublication once in a newspaper <br />of general circulation in the City of Lakewood as to all persons <br />who cannot be personally served. Said notice shall state the <br />time and place when objections can be heard before the Beard of <br />Revision of Assessments. <br /> <br /> Section 3. That this resolution is hereby declared to <br />be an emergency measure for the reasons stated in the preamble <br />hereof and provided it receives the affirmative vote of two- <br />thirds of all members elected to Council, it shall take affect <br />and be in force immediately upon its adoption and approval by <br />the Mayor. <br /> <br />Adopted: <br /> <br />March 15. 1965 <br /> <br />John G~ydos,~,Jr. <br /> President <br /> <br />Approved:March 22~ 1965 .... ~ <br /> <br /> Robert ~.
