Wendling, Bennett, RESOLUTZON NO. 4435 BY: Cain, Gaydos, Huffman, Usher, Ward° AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 314-25-186 on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the years 1965, 1966, 1967, 1968 and 1969. WHEREAS, the City has special assessment charged against the property hereinafter described and levied under Ordinance No. 27-65, adopted by the Council of the City of Lakewood on March l, 1965, and~ WHEREAS~ the owner of the said property has tendered pay- ment of the principal portion and interest on the special assess- ment levied on said parcel pursuant to the provisions of Section 5719o16 of the Revised Code of the State of Ohio, and~ WHEREAS, this resolution constitutes an emergency measure providing for the usual daily operation of a municipal department~ now~ therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $1~3.60 tendered in payment of the principal and interest for the years 1965 through 1969 of special assessment charged against the property described as permanent parcel number 314-25- 186 on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance No. 27-65~ adopted by the Council of the City of Lakewood on March l, 1965. Section 2. That said special assessment as hereinbefore set forth having been accepted as set forth in Section I hereof, and the Auditor of Cuyahoga County be and he is hereby authorized to cancel said special assessment for the years 1965, 1966, 1967, 1968 and 1969, levied under Ordinance No. 27-65~ adopted by the Council of the City of Lakewood on March l, 1965, on permanent parcel number 314-25-186 on the County Auditor's records and further described as being Sublot number 82 in the Cleveland Trust Compan- ies "Richland Htso" Subdivision, each annual assessment being in the amount of $28.72. Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this reso- lution to the Auditor of Cuyahoga County for the purpose of having said special assessment canceled. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all mem- bers elected to Council, it shall take effect and be in force im- mediately upon its adoption and approval by the Mayor.
