RESOLUTION NO.: 4509 <br /> <br />BY: Messrs. Gaydos, Huffman, Kelley, <br /> Usher, Wendling, Cain <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of <br />Public Works to rent certain equipment and employ the services <br />of G and R Sewer Construction Company to make repairs to a <br />sewer on Madison Avenue, without competitive bidding. <br /> <br /> ~a. IEREAS, On or about September 12, 1966, it was <br />discovered that a portion of the roof Of the sewer under <br />Madison Avenue at Morrison Avenue has caved in, and~ <br /> <br />WHEREAS, Immediate repairs thereto are mandatory, <br /> <br />and, <br /> <br /> WHEREAS, The exigencies of the situation demand <br />that repairs thereto be made forthwith, and, <br /> <br /> WHEP~AS, The City does not have the necessary <br />equipment and manpower to perform said repairs, and, <br /> <br /> ?~EREAS, A delay, in order to comply with the <br />competitive bidding requirements of the ~%arter of the City <br />of Lakewood, will be dangerous to the health, safety and <br />welfare of the citizens of Lakewood, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />in that it provides for the immediate preservation of the <br />public health, safety, welfare and property and provides for <br />the usual daily operation of a municipal department; now, <br />therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be <br />and he is hereby authorized to rent certain equipment and <br />employ certain manpower of G and R Sewer Construction Company <br />for the repairing of a sewer located under Madison Avenue at <br />Morrison Avenue without complying with the competitive bidding <br />requirements of Article V, Section 3 of the Charter of ~e City <br />of Lakewood. <br /> <br /> Section 2. That the Director of Finance is hereby <br />authorized and directed to pay to G and R Sewer Construction <br />Company for rental of equipment and labor necessary to make the <br />repairs to said sewer at the rate of $300°00 per day. Said <br />sum to be charged to the General Fund - Sewer Appropriation. <br /> <br /> Section 3. That this resolution is hereby declared <br />to be an emergency measure for the reasons stated in the pre- <br />amble hereof and provided it receives the affirmative vote of <br />two-thirds of all mermbers elected to Council, it shall take <br />effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br />Adopted: September,19~ !966 <br /> Charles S.
