Wendli~§._ <br /> AN EMERGENCY RESOLUTION authorizing an~ directing the mayor CZ <br />City of Lakewood to negotiate a contract with C. L. Todd, Consulting Engineer, <br />for the preparation of plans and specifications for the construction of a masonry <br />refuse burner at the Lakewood Incinerator, and authorizing the Director of Public <br />Works to advertise for bids for the construction of such burner. <br /> <br /> WHEREAS, preliminary plans have been prepared by C..L. Todd, Consulting <br />Engineer, for a masonry refuse burner at the Lakewood Incinerator, and, <br /> <br /> WHEREAS, it is the intention of the City of Lakewood to have these <br />plans completed so that bids may be received subject to approval of City Council, <br />and, <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br />i~m~ediate preservation of the public health and safety and for the usual daily <br />operation of a Municipal Department; now, therefore; <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor of the City of Lakewood be and he is hereby <br />authorized and directed to negotiate a contract with C. L. Todd, Consulting <br />Engineer, for the preparation of plans and specifications for construction of <br />a masonry refuse burner at the Lakewood Incinerator~ in accordance with prelim- <br />inary plans already prepared. <br /> <br /> Section 2. That such contract shall provide that the compensation <br />paid to C. L. Todd shall not exceed a fee equal to 5.5 per cent of the constrnction <br />cost or of the lowest bid received, of said burner plus 1.5 per cent for archi- <br />tectural and engineering supervision of construction, in the event such burner <br />is constructed. <br /> <br /> Section 3. That the Director of Public Works he and he is hereby <br />authorized to advertise for bids for the construction of such refuse burner in <br />accordance with the plans and specifications to be prepared by the Consultant. <br /> <br /> Section 4. That the advertisement for said bids shall provide for <br />and require that bids for the construction of said refuse burner shall be in <br />accordance with said plans and specifications and shall state that the City may <br />accept or reject any or all bids. <br /> <br /> Section 5. This Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives. <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force ~mediately upon its adoption. <br /> <br />Adopted: <br /> <br />December 1, 1966 <br /> <br /> December 1, 1966 <br />Approved: <br /> <br />Charles S.
