4569 - 67 Improve certain properties to widen Carabel Ave

Section 2. That said properties shall be improved es shown on the plans hereinaTter referred to and now on file in the office of the Director of Public Works for the off-street parking of motor vehicles by acquiring real estate, demolition of existing building$~ grading, paving, curbing, lighting, fencing and providing drainage facilitie~ together with the necessary appurtenances thereto snd widening Carabel Avenue along the front of the property described in Section i he~eof by relocating the curb and grading and paving. Section 3. Db is hereby determined and declsred that acid improve- ment is conducive to the public health, convenience snd welfare of said City and the inhabitants thereof. Section 4. That the grade of said improvement and street as im- proved shall be the grade as shown by the plans and profiles which ere made a part hereof. Section 5. That the plens~ specifications, estimates and profiles of the proposed improvement, heretofore prepared and now on file in the office of the Director of Public ~orks, are hereby approved. Section 6. That 98~ of the whole cost of said improvement shall be assessed by the percentage of the tax valuation upon the following described lots and lands, to wit: The property now or formerly owned by Harry Miller and Rose Miller and conveyed to them by deed recorded in Volume 9486 st Page 166 of Cuyahoga County Deed Records and filed for record on March 26~ 1959, by John A. Kupchik end Genevieve Kupchik and conveyed to them by deed recorded in Vol~nne 11345 at Page 679 of Cuyehoga County Deed Records and filed for record on October 23~ 1964, by Willy I. Sspell srzlPhyllis L. Sspell and conveyed to them by deed recorded in Volume lll87 at Page 569 of Cuyehoga County Deed Records snd filed for record on September 10, 1964, and by Mary Patrinka and conveyed to her by deed recorded in Volume 8673 at Page 735 of Cuyahoga County Deed Records and filed for record on August 31, 1956~ which said lots and l~nds are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the cost of preliminary and other surveys, plsns, spec~ficstions, profiles and estimates and of printing, serving and publish- ing notices~ resolutions and ordinances, the amount of damages resulting from the improvement assessed in fsvor of any owner of land affected by the im- provement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of pnr.~ chasing, appropriating, and otherwise acquiring therefor any required real estate or interests therein, payment of ad valorem taxes, expenses of legal services including obtaining sn approving legsl opinion~ cost of lsbor and material and interest on bonds and notes issued in anticipation of the levy and collection of the special assessments together with all other necessary expenditures. Section 7. That the Clerk of this Council be and she is hereby directed to deliver a certified copy of this resolution to the Director of Finance of this City. Section 8. That pursuant to Section 3 of Article XIV of the Charter of the City of Lakewood, the Director of Finance of this City be and he is hereby authorized and directed to prepare and file with this Council the esti- mated assessments of the cost of the improvement described in this resolution. When such estimated assessments have been so filed, said Director of Finance shall cause notice of the adoption of this resolution and the filing of said estimated assessments to be served on the owners of all lots and lands to be assessed as provided in Section 4 of said Article XIVwho have ~ot~,ai~'$~ service of such notice.
