4584. <br /> <br />,~ ..BY: Messrs, Cain, Gaydos, <br />~w,[rman, Kelley, Ward and Wendling <br /> <br /> AN Et~LERGENC¥ RESOLUTION aunhorizing payment of a moral <br />claim in the amount of $230.00, to Rrispy Kreme Donut Shop,14600 <br />Madison Avenue in the City of Lakewoodo <br /> <br /> WHEREAS, It has been alleged that certain equipmen~ valued <br />at the sum of $230.00 was mistakenly removed from the Krispy <br />Kreme Donut Shop bI- t%~e personnel. ~f the Division of Refuse <br />Collection and Disposal while sa~d personnel were collecting refus, <br />from the aforesaid business establ~.shment, and, <br /> <br /> WHEREAS~ Evidence has been presented to establish the pro.- <br />bability of such a mistake being made, and, '~ <br /> <br /> WHEREAS, This Council has determined that it has a moral <br />obligation to reimburse Krispy Kreme Donut Shop for the loss of <br />this equipment, and, <br /> <br /> WHEREAS This resolution <br /> ~ constl._utes an emergency measure <br />providing for the usual daily operation of a municipal deoartment; <br />now~ therefore~ <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Director of Finance be and he is hereb~ <br />authorized and directed to pay Krispy ~reme Donut Shop, as a <br />moral claim, the sum of $230.00 from the General Administration <br />Section (Damages) of th~ General Fund of the City of Lakewood. <br /> <br /> Section 2o That thi~ resolution is hereby declared to be <br />an emergency measur~ for the reasons state~ in the preamble hereoi <br />and provided it receives the affirmative vote of two-thirds of <br />all members elected to Council~ it shall take effect and be in <br />force immediately upon its adoption and approval by the ~ayor. <br /> <br />/~dopted: SeDtember 18, 1967 <br /> <br />Charles S.
