RESOLUTION NO. 4602 <br /> <br />BY: <br /> <br />Messrs. Kelley, Usher, Ward, <br />Wendling, Caydos, Huffman <br /> <br /> AN EMERGENCY RESOLUTION objecting to the issuance <br />of a D-2 liquor permit to applicant Madison Square Lanes, Inc. <br />for an establishment located at 1653 Westwood Avenue in the City <br />of Lakewood, Ohio. <br /> <br /> WHEREAS, Madison Square Lanes, Inc. has applied to <br />the Department of Liquor Control, State of Ohio, for a D-2 liquor <br />permit for the premises known as 1653 Westwood Avenue in the City <br />of Lakewood, Ohio, and, <br /> <br /> WHEREAS, An investigation of this establishment <br />reveals that the management has a history of permitting minors <br />to play pool' in violation of the Codified Ordinances of the <br />City of Lakewood and the statutes of the State of Ohio and the <br />manager of said establishment has been cited and convicted twice <br />in Lakewood Municipal Court for allowing minors to play pool, and, <br /> <br /> WI~EREAS, The present ~nagement of this establishment <br />has not cooperated with local law enforcement officers in the <br />investigation of said minors playing pool, and, <br /> <br /> WHEREAS, The present floor plan of this establishment <br />does not comply with the Codified ordinances of the City of <br />Lakewood in that the bar area is not separate from the rest of <br />the establishment and there is therefore no separate means of <br />ingress and egress to allow the groups of minors that often bowl <br />at this establishment to pass to and from the bowling alleys <br />without entering the bar area, and~ <br /> <br /> WHEREAS, This Council is of the opinion that the <br />reputability of the applicant is such that it is unsuitable for <br />the operation of a liquor establishment in the City of Lakewood, and~ <br /> <br /> WHEREAS, This establishmsnt is located in close <br />proximity to Grace Presbyterian Church and therefore not a suitable <br />location for a liquor establishment, and, <br /> <br /> WHEREAS, This resolution constitutes an emergency <br />measure in that it provides for the preservation of the public <br />peace, property, health and safety and for the usual daily opera- <br />tion of a municipal department; now, therefore, <br /> <br /> BE IT RESOLVED BY T~ COUNCIL OF THE CITY OF LAI~WOOD, <br />STATE OF OHIO: <br /> <br /> Section 1o That this Council hereby strenuously <br />objects to the granting~ by the Department of Liquor Control of the <br />State of Ohio, of the application of Madison Square Lanes, Inc. <br />for the issuance of a D-2 Liquor Permit for the premises known as <br />1653 Westwood Avenue, Lakewood, Ohio~ for the reasons stated above. <br /> <br /> Section 2. That the Clerk of Council is hereby <br />directed to submit two certified copies of this resolution and also <br />two signed statements listing the reasons for the objection, to the <br />Department of Liquor Control, State of Ohio, Permit Division, withi~ <br />thirty days from December 18, 1967. <br /> <br /> <br />
