RESOLUTION NO. BY: 4625 Messrs. Graber, Huffman, Kelley, Usher, ward, Wendling, Gaydos AN EMERGENCY RESOLUTION declaring it necessary to improve Wayne Avenue in the City of L~kewood by the necessary grading of the base~ resurfacing with asphaltic concrete including the necessary replacement and resetting of casting~ and the necessary resetting and replacing of curbs together with necessary appur- tenances thereto. W~iEREAS.~ this Cotu~cil by two-thirds vote of the .~nembers elected thereto determines that this resolution is o,n emergency measure which is necessary for the i~mnediate preservation of the public per, ce, pro~e~,~ty~ health and safety and for the further reason that the improve:~ents herein provided ere i.~aediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; N(~7, THEREFORE, BE IT RESOLVED by the Council of the City of Lakewood~ Avenue from Detroit Avenue to Crest Lane as set fort~ in Section 2 hereof. Section 2. Th~ said street shall be improved as shown on the plans hereinafter referred to and now on file in the office of the Director of IA~blic Works by the necessary grading of the base~ resurfacing with asphaltic concrete including the necessa~ replacement and resetting of castings and resetting and replacing the curbs together with the necessary appurtenances thereto. Section 3. It is hereby determined and declared that said improvement is conducive to the public health, convenience and welfare of said City ~nd the inhabitants thereof. Section 4. That the grade of said street as improved shall be the grade as shown by the plans ~nd profiles which are made a part hereof. Section 5. That the plans, specifications, estima'~es and profiles of the proposed ir~provement~ heretofore prepared and now on file in the office of the Director of'Public ?iorks~ are hereby approved. S~.~ction 6. That not more than 5U~ of the whole cost of aaid improve- ment shall be assessed by the benefits upon the following described lots and lands, to wit: All 3fhts and lands bounding and abutting upon the proposed improvement between the termini aforesaid~ which said lots and lands are hereby determined to be speci~lly benefited by said improvement~ and the cost of said improvement shall include the cost of preliminary and other surveys, plans~ specifications~ profiles end estimates ~d of printing~ serving and publishing notices~ resolut- tions and ordinances, the amount of damages resulting from the improvement assessed in f~vor of any ewner Of land a££ected by the i~%provement and the interest thereon~ the costs incurred in connection with the preparation: levy and collection of the special, assessments~ the coat of purchasing~ appropriating~ and. othe~.~ise acquir- ing therefor any requ. ired real estate or interests therein, expenses of legal ser- vices includin~ obtaining an approving legal opinion~ cost of l~bor and znaterial and interest on bonds and notes issued in anticipation of the levy end collection of the special assessments tojether x.~'ith all other necessary expenditures.
