RESOLUTION NO. 4673 BY: Messrs. Ward, Wendling, Gaydos, <br /> Graber, Huffman, Kellgy,'Usher <br /> <br />AN EMERGENCY RESOLUTION objecting to the removal of a D-l, D-2, and D-3 <br />Liquor Permit from Safe Keeping by Stephen and Margaret Mayer for <br />placement into operation at 16022-24 Madison Avenue in the City of <br />Lakewood, Ohio. <br /> <br />WHEREAS, Stephen and Margaret Mayer have applied to the Department of <br />Liquor Control, State of Ohio, for removal from safe-keeping a D-l, <br />D-2 and D-3 Liquor Permit for the premises known as 16022-24 Madison <br />Avenue, in the City of Lakewood, Ohio, and, <br /> <br />WHEREAS, The immediate neighborhood is overly saturated with liquor <br />and beer establishments at the present time, and, <br /> <br />WHEREAS, an investigation of the applicants indicates that they do not <br />intend to personally cor~duct a business at said location, but to the <br />contrary, applicants intend only to place a liquor license in operation <br />at said location for the express purpose of selling the business to <br />others, or placing said business under the exclusive control and manage- <br />ment of others, and, <br /> <br />WHEREAS, further investigation indicates that the person or persons <br />to whom applicants intend to transfer said business have close associa- <br />tion with persons whose operations are of a questionable character; <br />namely, one Anthony Pace, whose application for a liquor permit for <br />subject location has already been denied by the Director of Liquor <br />Control of the State of Ohio and which denial has been affirmed by <br />the Ohio Liquor Control Commission (Docket ~2149 - Case No. 17A-67) <br />and the Common Pleas Court of Cuyahoga County (Case No, 844291).and, <br /> <br />WHEREAS, This Council is of the opinion that~ by reason of the foregoing, <br />the premises in question are unsuitable for the location of a D-i, D-2 <br />and D-3 liquo~ permit, and, <br /> <br />WHEREAS, This resolution constitutes an emergency measure in that it <br />provides for the preservation of the public peace, property, health <br />and safety and for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That this Council hereby strenuously objects to the <br />application of Stephen and Margaret Mayer for the removal of a D~, <br />D-2, and D-3 liquor permit from safe-keeping to the premises known as <br />16022-24 Madison Avenue, Lakewood, Ohio, for the reasons stated above. <br /> <br />Section 2. That the Clerk of Council is hereby directed to submit two <br />certified copies of this resolution and also two signed statements listing <br />the reasons for the objection to the Department of Liquor Control, State <br />of Ohio, Permit Division, within thirty (30) days from November 14, 1968. <br /> <br />Section 3. That the President of Council designate a member of the Council <br />to represent Council at any hearings before the Depar~ent of Liquor <br />Control,State of Ohio. <br /> <br />Section 4.
