RESOLUTION NO. 4682 <br /> <br />BY: Messrs, Huffman, Kelley, Usher, <br /> Ward, Weodting, Gaydos <br /> <br />AN EMERGENCY RESOLUTION declartug the necessity and intent of the City of <br />Lakewood, Ohio, to appropriate certain real property located on the east <br />side of Gladye Avenue, owned by Gertrude L. Fuesner and Fred W. Fussuer, <br />bearing Permanent Parcel No. 312-14-20, and declaring an emergency. <br /> <br />WHEREAS, The real property hereinafter more fully described is needed for <br />the purpose of construction of off-street parking facilities, and, <br /> <br />WHEREAS, This resolution constitutes an emergency measure providing for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section I. That this Council hereby declares the necessity and intent <br />to appropriate the fee simple title in and to the following described <br />parcel of real estate necessary in connection with the construction of <br />off-street parking facilities pursuant to or in accordance with Article <br />XVIII of the Charter of the City of Lakewood, and the Constitution and <br />laws of the State of Ohio, to wit: <br /> <br />~a~cel Number 1 - 1383 Gladys Avenue <br />Permanent Parcel No, 312-14-20 <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State <br />of Ohio and known as being part of Original Rockport Township <br />Section No. 22 and bounded and described as fellows: <br /> <br />Beginning in the Easterly line of Gladys Avenue, at the South- <br />westerly corner of a parcel of land conveyed to Mary E. Wolf, <br />by deed recorded in Volume 2137 Page 624 of Cuyahoga County <br />Records; thence Easterly along the Southerly line of land so <br />conveyed to Mary E. Wolf, about 100.24 feet to the Westerly <br />line of Sub Lot No. 59 in Charles A. Cook's Allotment of part <br />of Original Rockport Township Section No. 22, as shown by the <br />recorded plat in Volume 25 of Maps, Page 2 of Cuyaho~aCounty <br />Records; thence Southerly along the Westerly line of said <br />Sub Lot No. 59 and the Westerly line of Sub Lot No. 58 in <br />said allotment, 63-68/100 feet to a point~ thence Westerly <br />about 100-34/100 feet to a point on the Easterly line of said <br />Cladys Avenue, which is distant Southerly measured along the <br />Easterly line of said Gladys Avenue 62-12/100 feet from the <br />place of beginning; thence Northerly along the Easterly line <br />of said Gladys Avenue, 62-12/100 feet to the place of beginning <br />and further known as Sub Lot No. 3 and the Southerly 10 feet <br />of Sub Lot No. 4 in Wigmore and Stuart's proposed Subdivision, <br />be the same more or less, but subject to all legal highways. <br /> <br />Section 2. That the Clerk of Council be and she is hereby authorized to <br />cause written notice of the adoption of this resolution to be given to <br />the owner, person in possession thereof or having an interest of record <br />in the above-described premises or to hie authorized agent and said <br />notice shall be served by a person designated for the purpose by said <br />Clerk of Council and return made in the manner provided by law. <br /> <br />Section 3. This resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, health and <br />safety of the said City and for the further reason that it is immediately <br />necessary to initiate the proceedings for the acquisition of said real <br />property in order to immediately proceed with its carrying out of the <br /> <br /> <br />
