-2- <br /> <br /> This easement is so situated that sanitary sewerage services <br />will~ be supplied to the property abutting a privately owned roadway in <br />Clifton Park Lago~] commonly known as Beach Head.. <br /> <br /> Section 2~ That said easement shall be imnroved as shown on the <br />plans hereinafter referred to and now on file {n the-office of the Director <br />of Public Works by the construction of a sanitary sewer, p~ping station <br />and force main~ together with curb connections therefor and other necessary <br />apptkrtenanccs thereto. <br /> <br /> Section 3. It is hereby determined and declared that said improve- <br />ment is conducive to the public health~ convenience and welfare of said City <br />and the inhabitants thereof. <br /> <br /> Section h. That the g~ade of said easement shall be the grade <br />as shown by the plans and profiles which are made a part hereof. <br /> <br /> Section 5. That the plans, specifications, estimates and profiles <br />of the proposed improvement, heretofore prepared and no'g on file in the office <br />of the Director of Public Works, are hereby approved, <br /> <br /> Section 6. That the whole cost of said improvement less one- <br />fiftieth of such whole costs shall be assessed in proportion to the benefits <br />upon the following described lots and lands~ to wit: <br /> <br /> All lots and lands bounding and abutting upon the proposed improve- <br />ment between the termini aforesaid~ which said lots and l~%ds are hereby <br />determined to be specially benefited by said improvement; and the cost of said <br />improvement shall include the cost of preliminary and other surveys~ plans, <br />specifications, profiles and estimates and of printing~ serving and publish~ <br />fng notices, resolutions and ordinances, the amount of d~nages resulting from <br />the improvement assessed in favor of any owner of land affected by the improve- <br />ment and the interest thereon~ the costs incurred in.connection with the pre- <br />paration, levy and collection of the special assessments: the cost of purchasing, <br />appropriating, and otherwise acquiring therefor any required real estate or <br />interests therein, expenses of legal services including obtaining an approving <br />legal opinion, cost of labor and material and interest on bonds and notes <br />issued in anticipation of the levy and collection of the special assessmen%s <br />together with all other necessary expenditures. <br /> <br /> Section 7. That the Clerk of this Council be and she is hereby <br />directed to deliver a certified copy of this resolution to the Director of <br />Finance of this City. <br /> <br /> Section 8. That pursuant to Section 3 of Article XIV of the <br />Charter of the City of Lakewood, the Director of Finauce of this City be and <br />he is hereby authorized and directed to prepare and file with this Council <br />the estimated assessments of the cost of the improvement described in this <br />resolution. ~en such estimated assessments have been so filed, said Director <br />of Finance shall cause notice of the adoption of this resolution and the <br />filing of said estimated assessments to be served on the owners of all lots <br />and lands to be assessed as provided in Section 4 of said Article XIV. <br /> <br /> Sectfon 9. That the assessments to be levied shall be paid in <br />twenty (20) semi-annual installments~ with interest on deferred payments <br />at the stone rate as shall be b~orne by the bonds to be issued in anticipation <br />of the collection thereof which is now estimated at six per centum per ann~un, <br />provided~ that the owner of any property assessed may, at his option, <br />pay suc:h assessment in cash within thirty days after passage o£.the assensJsg <br />ordinance. <br /> <br /> <br />
