-2- This easement is so situated that sanitary sewerage services will~ be supplied to the property abutting a privately owned roadway in Clifton Park Lago~] commonly known as Beach Head.. Section 2~ That said easement shall be imnroved as shown on the plans hereinafter referred to and now on file {n the-office of the Director of Public Works by the construction of a sanitary sewer, p~ping station and force main~ together with curb connections therefor and other necessary apptkrtenanccs thereto. Section 3. It is hereby determined and declared that said improve- ment is conducive to the public health~ convenience and welfare of said City and the inhabitants thereof. Section h. That the g~ade of said easement shall be the grade as shown by the plans and profiles which are made a part hereof. Section 5. That the plans, specifications, estimates and profiles of the proposed improvement, heretofore prepared and no'g on file in the office of the Director of Public Works, are hereby approved, Section 6. That the whole cost of said improvement less one- fiftieth of such whole costs shall be assessed in proportion to the benefits upon the following described lots and lands~ to wit: All lots and lands bounding and abutting upon the proposed improve- ment between the termini aforesaid~ which said lots and l~%ds are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the cost of preliminary and other surveys~ plans, specifications, profiles and estimates and of printing~ serving and publish~ fng notices, resolutions and ordinances, the amount of d~nages resulting from the improvement assessed in favor of any owner of land affected by the improve- ment and the interest thereon~ the costs incurred in.connection with the pre- paration, levy and collection of the special assessments: the cost of purchasing, appropriating, and otherwise acquiring therefor any required real estate or interests therein, expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on bonds and notes issued in anticipation of the levy and collection of the special assessmen%s together with all other necessary expenditures. Section 7. That the Clerk of this Council be and she is hereby directed to deliver a certified copy of this resolution to the Director of Finance of this City. Section 8. That pursuant to Section 3 of Article XIV of the Charter of the City of Lakewood, the Director of Finauce of this City be and he is hereby authorized and directed to prepare and file with this Council the estimated assessments of the cost of the improvement described in this resolution. ~en such estimated assessments have been so filed, said Director of Finance shall cause notice of the adoption of this resolution and the filing of said estimated assessments to be served on the owners of all lots and lands to be assessed as provided in Section 4 of said Article XIV. Sectfon 9. That the assessments to be levied shall be paid in twenty (20) semi-annual installments~ with interest on deferred payments at the stone rate as shall be b~orne by the bonds to be issued in anticipation of the collection thereof which is now estimated at six per centum per ann~un, provided~ that the owner of any property assessed may, at his option, pay suc:h assessment in cash within thirty days after passage o£.the assensJsg ordinance.
