RESOLUTION NO. 4790 BY: Messrs. Graber, Nuffman, Usher, <br /> Ward, Wendling, Gaydos <br /> <br />AN EMERGENCY RESOLUTION authorizing the Director of Law to approve <br />a Journal Entry to enable the "Interim" distribution of local <br />government funds. <br /> <br />WHEREAS, Certain litigation pending in the Supreme Court of <br />Ohio has the effect of preventing distribution of local govern- <br />ment funds, and, <br /> <br />WHEREAS, These funds are most necessary in the usual daily operation <br />of our municipality, and, <br /> <br />WHEREAS,The Supreme Court has indicated that if all the local <br />government units agree to a Journal Entry in the form attached, <br />a distribution of approximately 80% of an amount equal to the <br />"low" award by either the County Budget Commission or the Board <br />of Tax Appeals will be enabled, and, <br /> <br />WHEREAS, The entry has provisions for repayment in the event the <br />advance is greater than the final determination of this Court, and, <br /> <br />WHEREAS, This resolution constitutes an emergency measure for the <br />immediate preservation of the public welfare and for the usual daily <br />operation of a municipal- government; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF'THE CITY OF LAIEEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the Director of Law be and he is hereby authorized <br />to approve a Journal Entry in tm form set forth in Exhibit A attached <br />hereto, on behalf of the City of Lakewood <br /> <br />Section 2. That the Director of Law be and he is hereby authorized <br />to transmit a certified copy of this resolution, together with the <br />signed Journal Entry, to the Cuyahoga County Mayors and City Managers <br />Association for inclusion in a master Journal Entry to be presented <br />.to the Supreme Court of Ohio. <br /> <br />Section 3. That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its adoption and approval by the Mayor. <br /> <br />Adopted: ~ ,~2, /fT~ <br /> <br />Approved:. ~V-'~. j,/~7~ <br /> <br /> ~resident <br /> <br /> Clerk <br /> <br />' Mayor <br /> <br /> <br />
