RESOLUTION NO. 4844 BY: Messrs. Graber, Huffmsn, <br /> Kelley, Usher, Wsrd, Wendling, <br /> Gsydos <br /> AN EMERGENCY RESOLUTION authorizing the Director of Law to approve <br />a Journal Entry to enable the "interim" distribution of local government funds. <br /> <br /> WHEREA~, certain litigation pending in the Franklin County <br />Court of Appeals'~has the effect of preventing distribution of the 1971 <br />local government funds; and <br /> <br /> WHEREAS, it is necessary that we have as mue~ of these funds as is <br />possible in order to meet the financial needs of our municipality, and <br /> <br /> WHEREAS, the Franklin County Court of Appeals has indicated that if <br />all or substantially all governmental units agree to a Journal Entry in the form <br />attached, a distribution of approximately ninety percent (90%) of an amount equal <br />to the "low" award by either the County Budget Commission or the Board of Tax <br />Appeals will be permitted, and <br /> <br /> WHEREAS, the proposed Journal Entry has provisions for repayment in the <br />event the advance to any subdivision is greater than the final determination of <br />the Court, and <br /> <br /> WREREAS, this resolution constitutes an emergency measure for the <br />immediate preservation of the public welfare and for the usual daily operation of <br />a municipal government; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Law be and he is hereby authorized to <br />approve and to execute on behalf of the City a Journal Entry, in the form set forth <br />in Exhibit A attached hereto, auth6rizing an interim distribution of local govern- <br />ment funds. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br />and directed to transmit a certified copy of this resolution together with the <br />signed Journal Entry co the Cuyahoga County Mayors and City Managers Association <br />.f.o~ inclusion in a master Journal Entry to be presented to the Franklin County <br />Court of Appeals. <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force i~ediately.upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />Cler~/ <br /> <br />Mayor <br /> <br /> <br />
