RESOLUTION NO. 4853 BY: Messrs. Gaydos, Graber, <br /> Huffman, Kelley, Usher, <br /> Ward, Wendling <br /> AN EMERGENCY RESOLUTION disapproving plans and specifications submitted by <br />the Cleveland Electric Illuminating Company for the construction of an overhead <br />electric transmission power line through the City of Lakewood, the proposed voltage <br />to be carried being 33,000 volts and denying a permit therefore. <br /> <br /> WHEREAS, the Cleveland Electric Illuminating Company submitted for approval, <br />plans and specifications for the construction of an overhead electric transmission <br />power line through the City of Lakewood, which line would carry 33,000 volts and has <br />made application for a permit.therefore, and <br /> <br /> WHEREAS, said application was referred by this Council to the Utilities <br />Cormnittee for study and report, and <br /> <br /> WHEREAS, the Cleveland Electric Illuminating Company has represented to this <br />Council that it will not consider underground installation of the proposed electric <br />transmission power line, and <br /> <br /> WHEREAS, the Utilities Committee of Council has determined that the construct- <br />ion, operation and maintenance of the proposed overhead electric transmission power line <br />would unreasonably affect the welfare of the general public and in particular the resi- <br />dents of the City of Lakewood, and recommends the rejection of the aforesaid application <br />and the denial of a permit therefore, and <br /> <br /> WHEREAS, this Council, being fully advised in the premises, concurs in the <br />report of its Utility Committee, and <br /> <br /> WttEREAS, this Resolution constitutes an emergency measure in that it provides <br />for the immediate preservation of the public safety and welfare and for the usual daily <br />operation of municipal departments, now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That pursuant to authority of Section 731.02 of the Business <br />Regulation Code of the Codified Ordinances of the City of Lakewood, Council does here- <br />with reject the application of Cleveland Electric Illuminating Company to construct an <br />overhead electric transmission high power line through the City of Lakewood'and does <br />herewith deny a permit for same. <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the affirmative <br />vote of two-thirds of all members elected to Council, it shall take effect and be in <br />force immediately upon its adoption and approval by the Mayor. <br />Adopted: .~_~/~ /~O/ ~ ~ ~~~ ' ° <br /> <br />Mayor <br /> <br /> <br />
