RESOLUTION NO. 4890 BY: Messrs. Magnotto, Usher, <br /> Wendling, Brockman, Graber, <br /> Kelley, McBride <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Works to <br />rent certain equipment and purchase necessary material to make repairs to a <br />sewer on Detroit Avenue, without competitive bidding. <br /> <br /> WHEREAS, on or about June 2, 1972, it was discovered that portions <br />of the sanitary sewer under Detroit Avenue between Robinwood and Park Haven <br />has caved in, and <br /> <br />WHEREAS, immediate repairs thereto are mandatory, and, <br /> <br /> WHEREAS, the exigencies of the situation demand that repairs thereto <br />be made fOrthwith, and, <br /> <br /> WMEREAS, the City does not have the necessary equipment and materials <br />to perform said repairs, and, <br /> <br /> WHEREAS, a delay, in order to comply with the competitive bidding <br />requirements of the Charter of the City of Lakewood, will be dangerous to the <br />health, safety and welfare of the citizens of Lakewood, and, <br /> <br /> WHEREAS, this resolution constitutes an emergency in that it provides <br />for the immediate preservation of the public health, safety, welfare and property <br />and provides for the usual daily operation of a municipal department; now, there- <br />fore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized to rent certain equipment and purchase necessary material for the <br />repairing of a sewer located under Detroit Avenue between Robinwood and Park <br />Haven, without complying with the competitive bidding requirements of Article V, <br />Section 3 of the Charter of the City of Lakewood. <br /> <br /> Section 2. That the Director of Finance is hereby authorized and <br />directed to pay the necessary costs for rental of equipment and purchase of <br />materials necessary to make the repairs to said sewer, the total cost of which <br />is not to exceed $20,000.00. Said sum to be charged to the General Fund - <br />Sewer Appropriation. <br /> <br /> Section 3. That this resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor. <br />Adopted:,..~r~z/ ~/ /~7~/ ~ <br /> <br />Clerk <br /> <br />Approved: ~(~~ ~-z//~' 7~~'/ <br /> <br />Mayor <br /> <br /> <br />
