RESOLUTION NO. <br /> <br />4900 <br /> <br />Messrs. Graber, Magnotto, McBride, <br />Usher, Wendling, Broekman <br /> <br /> AN EMERGENCY RESOLUTION objecting to the issuance of a D-1 liquor <br />permit to applicant Michael J. Santosuosso and Patricla Cullitan dba Paguelis <br />Pizza, an establishment located at 18198 Sloane Avenue in the City of Lakewood, <br />Ohio. <br /> <br /> WHEREAS, Michael J. Santosuosso and Patricia Cullitan dba Paguelis Pizza <br />have applied to the Department of Liquor Control, State of Ohio, for a D-1 liquor <br />permit for the premises known as 18198 Sloane Avenue in the City of Lakewood~ Ohio, <br />and <br /> <br /> W_~REAS, investigation reveals that this establishment is located in the <br />Sloane Shopping Center, which area has long been a gathering place for teenage <br />youth and a constant source of problems for the Lakewood Police Department, the <br />merchants located in the shopping center, and the residents in the surrounding <br />area,and <br /> <br /> W~REAS, further investigation discloses that many students from the <br />nearby Horace Mann Middle School and even 4th and 5th grade students from McKinley <br />Elementary School frequent the applicant~ place of business for pizza on the way <br />home from school, and <br /> <br /> WHEREAS, the applicants for the aforesaid D-1 permit have had no prior <br />experience in operating a business which owned a liqugr permit, and <br /> <br /> WHEREAS, this Council is of the opinion that, by reason of the foregoing, <br />the premises in question are unsuitable for the location of a D-1 liquor permit, and <br /> <br /> WHEREAS, this resolution constitutes an emergency measure in that it <br />provides for the immediate preservation of the public peace, property, health and <br />safety and for the usual daily operation of a municipal department, now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITYOF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council s~mnuously objects to the ~rantin~ by the <br />Department of Liquor Control of the State of Ohi% of the application of Michael J. <br />Santosuosso and Patricia Cullitan dba Paguelis Pizza for the issuance of a D-1 <br />liquor permit for the premises known as 18198 Sloane Avenue, Lakewood, Ohio, for <br />the reasons above stated. <br /> <br /> Section 2. That the Clerk of Council is hereby directed to submit <br />two certified copies of this resolution and also two signed statements listing <br />the reasons for the objection, to the Department of Liquor Control, State of Ohio, <br />Permit Division, within thirty (30) days from August 31, 1972. <br /> <br /> Section 3. That the President of Council designate a member of the <br />Council to represent Council at any hearings before the Department of Liquor Control, <br />State of Ohio. <br /> <br /> Section 4.
