RESOLUTION NO'. 4952 <br /> <br />BY: Messrs. Graber, Magnotto, McBride, <br /> Sinagra, Usher, Werner, Brockman <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public <br />Works to negotiate fQr such supplemental fuel supplies as may be required for <br />the operation of the Waste Water Treatment Plant at the best price obtainable <br />without advertising or competitive bidding. <br /> <br /> WHEREAS, the present fuel shortage makes it necessary to secure <br />supplemental supplies of heating fuel for the proper operation of the Waste <br />Water Treatment Plant, and, <br /> <br /> WHEREAS, the exigencies of the situation demand that supplies <br />of heating fuel be obtained as soon as possible, and, <br /> <br /> WHEREAS, a delay in order to comply with the competitive bidding <br />reqUirements of the Charter of the City of Lakewood, will be dangerous to the <br />health, safety and welfare of the citizens of Lakewood, and, <br /> <br /> WHEREAS, this resolution constitutes an emergency in that it <br />provides for the inuuediate preservation of the public health, safety, welfare <br />and property and provides for the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br />OHIO: <br /> <br /> Section 1. It is hereby determined that an emergency exists <br />and that the present fuel shortage makes it necessary to secure supplemental <br />supplies of heating fuel as soon as possible, and that it is in the best interest <br />of the City to purchase said fuel supplies without bidding and advertising <br />under authority of the ra~ised code 735.051. <br /> <br /> Section 2. That the Director of Public Works be and he is hereby <br />authorized to negotiate for supplemental fuel supplies as may be determined <br />necessary and at the best price obtainable as purchases are made from time to <br />time for use at the Waste Water Treatment Plant. <br /> <br /> Section 3. That the Director of Finance is hereby authorized and <br />directed to pay for the required purchases of heating oil, said sums to be <br />charged to the Waste Water Treatment Plant Fund. <br /> <br /> Section 4. That this resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and' be in force immediately upon its adoption <br />and approval by the Mayor. <br /> <br />Approved:~z-~ <br /> <br />Mayor <br /> <br /> <br />
