RESOLUTION NO. 4965 <br /> <br />BY: Messrs. Graber, Magnotto, Singara, Usher, <br /> Werner, Brockman <br /> <br /> AN EMERGENCY RESOLUTION declaring the necessity and intent of the <br />City of Lakewood to appropriate permanent easements in, over, through, upon, <br />under and across the following parcels of real property located in the City <br />of Lakewood, County of Cuyahoga and State of Ohio: 12922 Clifton Boulevard, <br />owned by Harry E. and Marjorie E. Gibson;' 12930 Clifton Boulevard, owned by <br />Melvin L. and Tuula A. Mo Fitzpatrick; 12921-23 Lake A~enue, owned by Frances E. <br />Herr; and 12919 Lake Avenue, owned by J. Vincent and Mary Margaret Car~,yo <br /> <br /> WHEREAS, permanent easements and a perpetual r!gh~ license and <br />privilege to construct, maintain, repair, renew, operate and use a sanitary and <br />storm water sewer are needed for the purFcse of construction and maintenance of <br />the Hazelwood-Thoreau-Donald sewer project of the ~i~-- of Lakewood, and, <br /> <br /> W}{EREAS, this resolution consti~taz ~n emergency measure providing <br />for the usual daily operation of a municip=i department and for the immediate <br />preservation of the public health, safety and welfare in that the City has <br />experienced increasing difficulty with the problem of flooding basements in <br />the aforementioned area and the surroundin~ ~e~horhood, which flooding will <br />relieved with the construction of t~e Haze.~o,~.~z~au-Donald sewer p~-~j~ ~C <br />which relief should be effected at the earlie~ ~o$~i? le time, now, therefore~ <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY O~ ' ~ ~OD, STATE OF OHIO: <br /> <br />Section 1. That this council hereby declares the necessity and intent to <br />appropriate permanent easements in, over, through, upon, under and across the <br />following described certain parcels of real estate necessary in connection with <br />the construction of the Hazelwood-Thoreau-Donald sewer project in the City of <br />Lakewood, Ohio: <br /> <br />Parcel NO. 1 - 12922 Clifton Boulevard <br />Owners: Harry E~ and Marjorie E. Gibson -- a part of Permanent Parcel Noo 312-27-48 <br /> <br /> Being a strip of land fifteen feet in width and more particularly <br />described as follows: <br /> <br /> Situated in the City of Lakewood, County of Cuyahoga and State <br /> of Ohio and being part of Section 21 of Original Rockport <br /> Township and being further described as follows: <br /> <br />Beginning at a point in the northerly line of Clifton Boulevard, <br />120' wide, at the southwest corner of a parcel of land conveyed <br />to Marry E. and Marjorie E. Gibson by deed recorded in Volume <br />7449 Page 354 of Cuyahoga County Records; thence easterly along <br />said northerly line of Clifton Boulevard 15 feet to a point; <br />thence northerly along a line parallel with the westerly line of <br />said Gibson parcel 169 feet to a point in the northerly line of <br />said Gibson parcel; thence westerly along said Northerly line 15 <br />feet to the northwest corner of said Gibson parcel; thence south- <br />erly 169 feet along the westerly line of said Gibson parcel to the <br />place of beginning, be the same more or less b~t excepting therefrom <br />al! lands now covered by any residence. <br /> <br />Parcel No. 2 - 12930 Clifton Boulevard <br />Owners: Melvin L. and Tuula A.
