RESOLUTIONNO. 4972 .... BY: <br /> <br />Messrs. Graber, Magnotto~ McBride, <br />S%nagr~ Werner, Brockman, USher <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the <br />City of Lakewood to accept the principal and interest on special assessment <br />levied on permanent parcel number 311-30-61, and known for street numbering <br />purposes as 1351 Ethel Avenue, on the Cuyahoga County Auditor's records and <br />authorizing the County Auditor to cancel said special assessment for the <br />years 1974 and 1975. <br /> <br />WHEREAS, the City of Lakewood has special assessment charged against the property <br />hereinafter described and levied under Ordinance Ne.17-71, adopted by the Council <br />of the City of Lakewood on March 15, 1971, and <br /> <br />WHEREAS, the owner of the said property has tendered payment of the principal <br />portion and interest on the special assessment levied on said parcel pursuant <br />to the provisions of Section 5716.16 of the Revised Code of the State of Ohio, <br />and <br /> <br />WHEREAS, this resolution constitutes an emergency measure providing for the usual <br />daily eperation of ~municipal department; now, therefore: <br /> <br />BE I~RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1o That the Director of Finance of the C~ty of Lakewood be and he is <br />hereby authorized and directed to accept the sum of $39olz tendered in payment <br />of the principal and interest for the years 1974 and 1975, of special assessment <br />charged against the property described as permanent parcel number 311-30-61 <br />on the Auditor's records of Cuyahoga County, Ohio, and.levied under Ordinance <br />No. 17-71 adopted by the Council of the City of Lakewood on March 15, 1971. <br /> <br />Section 2. That said special assessment as hereinbeforeset forth having been <br />accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County <br />be and he is hereby authorized to cancel said special assessment for the years <br />1974 and 1975, levied under Ordinance No. 17-71, adopted by the Council of the <br />City of Lakewood on March 15, 1971, on permanent parcel number 311-30-61 on the <br />County Auditors records and further described as being in the Richmond Park <br />Subdivision, Volume 29, page 23, each annual assessment being in the amount of <br />$19.56. <br /> <br /> Section 3. That the Clerk of Council be and she is hereby authorized and <br /> directed to deliver a certified copy of this resolution to the Auditor of <br /> C~yahoga County for the purpose of having said special assessment canceled. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency measure <br /> for the reasons stated in the preamble hereof and provided it receives the <br /> affirmative vote of two-thirds of all members elected to Council, it shall take <br /> effect and be in force immediately upon its adoption and approval by the Mayor° <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />Cl9rk~/ <br /> <br />Mayor <br /> <br /> <br />
