-2- <br /> <br />studies to determine the proper rate structure for the Cleveland Water <br />System in order to gain insurance that the problems of the future have <br />been well considered and to provide testimony in any legal action which <br />may be instituted under Section 1 of this Resolution. <br /> <br /> Section 3. The Suburban Water Rate Committee of the Cuyahoga <br />County Mayors and City Managers Association is authorized to coordinate <br />such legal action and to employ such professional assistance as it may <br />deem necessary to carry out the intention of Sections 1 and 2 of this Reso- <br />lution and other incidental, necessary and related work. <br /> <br /> Section 4. The Clerk is authorized, empowered and directed to cer- <br />tify a copy of this legislation to the Executive Secretary of the Cuyahoga <br />County Mayors and City Managers Association. <br /> <br /> Section 5. The sum of $3,508.65 is hereby appropriated and shall <br />be paid to the Cuyahoga County Mayors and City Managers Association for the <br />purpose of paying the expenses incidental to the coordination of such activity <br />amd employment of professional assistance, which funds shall be held in escrow, <br />disbursed as necessary, and accounted for at reasonable intervals or at any <br />time upon request, with the unused portion of funds to be returned to this <br />municipality at the conclusion of litigation. <br /> <br /> Section 6. That this resolution is hereby declared to be an emer- <br />gency measure for the reasons stated in the preamble hereof, and provided it <br />receives the affirmative vote of two-thirds of all members elected to Oouncil, <br />it shall take effect and be in for~e immediately upon its adoption and approval <br />by the Mayor. <br /> <br />Mayor <br /> <br /> <br />
