RESOLUTION NO. 5034 <br /> <br />BY: Messrs. Sinagra, Usher, Brockman, <br /> Chinnock, Graber, Magnotto, McBride <br /> <br /> AN EMERGENCY RESOLUTION requesting the Director of Transportation to <br />review the Engineering and Traffic Investigation for the purpose of declaring <br />a reasonable and safe prima~facie speed limit for Edgewater Drive, from its <br />eastern terminus at West ll7th Street to its western terminus 100 feet west~of <br />Cove Avenue, and for Cove Avenue from its northern terminus at Edgewater Drive <br />to Lake Avenue in the City of Lakewood. <br /> <br /> WHEREAS, that portion of Edgewater Drive situated between West ll7th <br />Street and Cove Avenue, and that portion of Cove Avenue situated between Edgewater <br />Drive and Lake Avenue, together constitute an integral artery of the traffic flow <br />pattern through the City of Lakewood, and <br /> <br /> WHEREAS, this Council has caused to be made an Engineering and Traffic <br />Investigation upon the aforesaid portions of Edgewater Drive and Cove Avenue, and <br /> <br /> WHEREAS, this Council has determined upon the basis of said Engineering <br />and Traffic Investigation that the prima-facie speed permitted under Sections <br />4511.01 to 4511.78 and 4511.99 of the Ohio Revised Code on the aforesaid portions <br />of Edgewater Drive and Cove Avenue, to wit, 35 miles per hour, is greater than is <br />reasonable and safe un, der the conditions found to exist at such location, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare and for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. Pursuant to the provisions of Section 4511.21 of the Ohio <br />Revised Code, the Director of Transportation is hereby requested to review the <br />Engineering and Traffic Investigation and to determine and declare a reasonable <br />and safe prima-facie speed limit, to wit, twenty-five (25) miles per hour, for <br />Edgewater Drive, from its eastern terminus at West ll7th Street to its western , <br />terminus 100 feet west of Cove Avenue, and for Cove Avenue from its northern <br />terminus at ~dgewater Drive to Lake Avenue in the City of Lakewood. <br /> <br /> Section 2. That upon notification by the Director of Transportation <br />that the prima-facie speed limit has been altered, this Council acknowledges <br />that such altered speed limit shall bec~ne effective only when appropriate signs <br />giving notice thereof are erected at such location. <br /> <br /> Section 3. That the Clerk of Council is hereby authorized and directed <br /> to forward a certified copy of this Resolution, together with a copy of the City's <br /> Engineering and Traffic Investigation, to the Director of Transportation of the <br /> State of Ohio. <br /> <br /> Section 4.
