RESOLUTION NO. 5042 <br /> <br />BY: Messrs. Brockman, Chinnock, Graber, <br /> Magnotto, McBride, Sinagra, Usher <br /> <br /> A RESOLUTION declaring the intent of the City of Lakewood to join <br />with other general purpose units of local government within the Northeast <br />Ohio Area (Cuyahoga, Geauga, Lake, Lorain, Medina, Portage and Summit Counties) <br />to develop and implement a plan resulting in a coordinated Waste Treatment <br />Management System for the Northeast Ohio Area. <br /> <br /> WHEREAS, Amendments pursuant to Section 208 of the Federal Water <br />Pollution Control Act of 1972, public law 92-500, hereinafter called the Act, <br />the Administrator of the United States Environmental Protection Agency (USEPA) <br />has promulgated guidelines for identification of those areas which as the result <br />of urban industrial concentration or other factors have substantial water quality <br />control problems (40 CFR, Part 126), and <br /> <br /> WHEREAS, Seven Counties within Northeast Ohio Complex #10, consisting <br />of the Counties of Cuyahoga, Geauga, Lake, Lorain, Medina, Portage, and Summit, <br />hereinafter called the area, satisfy the criteria contained in the Act and <br />guidelines, and designation of the Area pursuant to the Section 208 of those <br />guidelines is desirable, and <br /> <br /> WHEREAS, Section 126.10 of the guidelines requires, among other things, <br />that the affected general purpose units of local government in the problem area <br />must show their intent to formally adopt a resolution, to chart together in the <br />planning process, and to develop and implement a plan which will result in a <br />coordinated Waste Treatment Management System for this area, and <br /> <br /> WHEREAS, such planning process and Waste Treatment Management System <br />is necessary as a significant measure to control present point and non-point <br />water pollution ~nd to guide and regulate future development and that development <br />in the area which may affect water quality in order to best abate and solve <br />existing and potential substantial water quality control problems; now, therefore~ <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAREWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the City of Lakewood recognizes that the Northeast <br />Ohio area has substantial water quality control problems and supports the desig- <br />nation of the area pursuant to Section 208 of the Act and the EPA guidelines. <br /> <br /> Section 2. That the City of Lakewood declares its intent to join with <br />other affected general purpose units of local government within the boundaries of <br />the area to develop and implement a plan which will result in a coordinated Waste <br />Treatment Management System for the Area; and <br /> <br /> Section 3. That inasmuch as the Northeast Ohio Areawide Coordinating <br />Agency is the single representative organization with elected and appointed <br />officials of general purpose local government capable of developing the necessary <br />areawide waste treatment management plan for the area, the City of Lakewood <br />supports the designation of that organization as the Section 208 planning agency <br />for the area. <br /> <br /> Section 4.
