RESOLUTION NO. 5078 BY: Messrs. Brockman, Graber, Chinnock, McBride, Simgra, Usher AN EMERGENCY RESOLUTION authorizing and directing the Director of Law to.file a declaratory judgment action or other appropriate proceedin~ in the Common Pleas Court of Cuyahoga County to compel the demolition and removal of the building situated at 16024-26 Madison Avenue, Lakewood, Ohio, determined to be an unsafe structure and public nuisance. WHEREAS, pursuant to the provisions of Section 1603.50 of the Building Code of the City of Lakewood, the building located at 16024-26 Madison Avenue, Lakewood, Ohio has been declared to be an unsafe structure by reason of inadequate maintenance, abandonment and dilapidation, and as such unsafe structure has been further declared to be a public nuisance, and WHEREAS, the owner of said building has been notified to abate said nuisance by repair, rehabilitation, demolition or removal of said structure but has failed to comply with said notice, and WHEREAS, this Council is. of the opinion that appropriate legal action should be taken immediately so as to abate this public nuisance at the eaK.~iest possible time, and WHEREAS, this Resolution constitutes an emergency measure providing for the in~nediate preservation of the public health, safety and welfare; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Law be and he is her.eby authorized and directed to proseoate an action in declaratory judgment or other appropriate proceeding in the Common Pleas Court of Cuyahoga Cou.nty against the owners of the building at 16024-26 Madison Avenue, Lakewood, Ohio to effect the demolition and removal of said building. Section 2. That this Resolution is hereby declared to be an emergency effect and be in force immediately upon its ad~tion~a~nd.[p~y, th~ Mayor.
