RESOLUTION NO. 5089 BY: Messrs. Graber, Magnotto, McBride, Sinagra, Usher, Brockman, Chinnock AN EMERGENCY RESOLUTION requesting the Director of Transportation of the State of Ohio to review the Engineering and Traffic Investigation for the purpose of declaring a reasonable and safe prima-facie speed limit for Warren Road, from its northern terminus at Clifton Boulevard to its southern terminus at Lakewood Heights Boulevard in the City of Lakewood. WHEREAS, request has been made to this Council to reduce the speed limit for Warren Road in the City of Lakewood for the reason that the statutory speed limit permitted'by Section 4511.21 of the Ohio Revised Code is greater than that considered reasonable and safe, and WI~REAS, this Council has caused to be made an Engineering and Traffic Investigation upon the aforesaid Warren Road from its northern terminus at Clifton Boulevard to its southern terminus at Lakewood Heights Boulevard, and WHEREAS, this Council has determined on the basis of said Engineering and Traffic Investigation that the prima-facie speed permitted under Sections 4511.01 to 4511.80 and 4511.99 of the Ohio Revised Code on the aforesaid Warren Road, to wit, 35 miles per hour, is greater than is reasonable and safe under the conditions found to exist at such location, and W}~REAS, this Resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section t. Pursuant to the provisions of Section 4511.21 of the Ohio Revised Code, the Director of Transportation of the State of Ohio~is hereby requested to review the Engineering and Traffic Investigation and to determine and declare a reasonable and safe prima-facie speed limit, to wit, twenty-five (25) miles per hour, for Warren Road, from its northern terminus at Clifton Boulevard to its southern terminus at Lakewood Heights Boulevard in the City of Lakewood. Section 2. That upon notification by the Director of Transportation that the prima-facie speed limit has been altered, this Council acknowledges that such altered speed limit shall become effective only when appropriate signs giving notice thereof are erected at such location. Section 3. That the Clerk of Council is hereby authorized and directed to forward a certified copy of this Resolution, together with a copy of the City's Engineering and Traffic Investigation, to the Director Of Transportation of the State of Ohio. Section 4.
