RESOLUTION NO. 5123 GiVI~N, ~,[T[[ DOCKET By:Messrs. Brockman, Chinnock, Magnotto, McBride, Salmon, Sinagra, Usher AN EMERGENCY RESOLUTION authorizing and directing the Finance Director of the City of Lakewood to accept the principal and interest on special assessment levied on permanent parcel number 312-14-17~ and known for street numbering purposes as 1372 Cook AVenue, on the Cuyahoga County Auditor's records and authorizing the County Auditor to cancel said special assessment for the year ~976. WHEREAS, the City of Lakewood has special assessment charged against the property hereinafter described and levied under Ordinance No. 25-72, adopted by the Council of the City of Lakewood on March 6, 1972, and WHEREAS, the owner of the said property has tendered payment of the principal portion and interest on the special assessment levied on said parcel pursuant to the provisions of Section 5716.16 of the Revised Code of the State of Ohio, and WHEREAS, this resolution constitutes an emergeecy measure providing for the usual daily oparation of a municipal department; now, therefore: BE IT RESOLVED BY TIlE COUNCIL OF ~tE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance of the City of Lakewood be and he is hereby authorized and directed to accept the sum of $26.52 tendered in paDnent of the principal and interest for the year [976 of special assessment charged against the property described as permanent parcel number 312-14-17 on the Auditor's records of Cuyahoga County, Ohio, and levied under Ordinance No. 25-72, adopted by the Council of the City of Lakewood on March 6, 1972. Section 2. That said special, assessment as hereinbefore set forth having been accepted as set forth in Section 1 hereof, and the Auditor of Cuyahoga County be and he is hereby authorized to cancel said special assessment for the year 1976 levied under Ordinance No. 25-72, adOpted by the Council of the City of Lakewood on March 6 1972, on permanent parcel number 312-14-17 on the County Auditor's Records and furtber described as being the Charles Cook Subdivision, Volume 25, Page 2, each annual assessment being in the amount of $26.52. Section 3. That the Clerk of Council be and she is hereby authorized and directed to deliver a certified copy of this resolution to the Auditor of Cuyahoga County for the purpose of having said special assessment canceled. Section 4. That this resolution is hereby declared to be an emergency measure for the reasons stated in tbe preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
