RESOLUTION NO, 5144 <br /> <br />BY: Messrs. Salmon, Usher, Brockman, <br /> Chinnock, Magnotto <br /> <br /> AN E~RGENCY RESOLUTION declaring the necessity and intent of the <br />City of Lakewood to appropriate the real property located at 16022-26 Madison <br />Avenue in the City of Lakewood, County of Cuyahoga and State of Ohio, owned <br />by Chung's Foods Corporation, an Ohio corporation, and bearing Permanent Parcel <br />No. 3i13-24-23 & 24. <br /> <br /> WHEREAS~ the real property hereinafter more fully described is n~eded <br />for municipal use for a Senior Center and Office on Aging for the City of ~akewood, <br />and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br />the usual daily operation of a municipal department and for the further, reason <br />that this Council determines it to be in the best interest of the City that said <br />property be purchased at the earliest possible time so that a Senior Center and <br />Office on Aging can be developed at said location at the earliest possible time; <br />now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD~ STATE OF OHIO: <br /> <br /> Section 1. That this CounCil hereby determines it necessary and declares <br />it to be the intention of this Council to appropriate the fee simple interest in <br />and to the premises hereinafter described for the purpose of using same for a <br />Senior Center and Office on Aging for the City of Lakewood, Ohio: <br /> <br />16022-26 Madison Avenue, Lakewood, Ohio <br /> <br />Owner: Chung's Foods Corporation <br /> <br />Permanent Parcel No. 313-24-23 & 24 <br /> <br />Situated in the~ City of Lakewood, County of Cuyahoga <br />and State of Ohio, and known as being Sublots Nos. 56, <br />57 and 58 in The Advance Real Estate Company's Sub- <br />division NOo 1 of part of Original Rockpo=t Township <br />Sections Nos. 18 and 23 as shown by the recorded plat <br />in Volume 40 of Maps, Page 20 of Cuyaho§a County Records, <br />together forming a parcel of land 130.52 feet front on <br />the Northerly side of Madison Avenue and extending back <br />156.60 feet deep on the Easterly line, 144.90 feet daep <br />on the Westerly line, which is also the Easterly line of <br />Northland Avenue and having a rear line of 130 feet~ as <br />appears by said plat, be the same more or less, but sub- <br />ject to all legal highways, <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized <br />and!directed to cause written notice thereof to be given to the owner of, person <br />in possession of~ or person having an interest of record therein, or to his <br />authorized agentl, and said notice shall be served by a person designated for the <br />purpose by said Clerk of Council and return made in the manner provided by law <br />for the service and return of surmnons in civil actions. <br /> <br /> Section 3.
