RESOLUTION NO. 5147 BY: <br /> <br />Messrs. Chinnock, Mag~otto, McBride, <br />Sa]fmoni Sinagr@, Usher, Brockman <br /> <br /> AN EMERGENCY i~SOLUTION authorizing the City of Lakewood, Ohio to join <br />with other municipalities in litigation against the City of Cleveland with regard <br />to water service, authorizing the Suburban Water Task Force Committee of the <br />Cuyahoga County Mayors and City Managers Association to Coordinate efforts and <br />receive and expend funds therefor; and declaring an emergency, <br /> <br />from the <br />a master <br /> <br />WHEREAS, water consumers in the City of Lakeweod receive water service <br />City of Cleveland, either directly or through this suburb by means of <br />meter, and <br /> <br /> WHEREAS, it bas been reported that the operation of the water filtration, <br />purification and distribution system of the City of C;leveland may be unable to cope <br />with tile requirements of the users of water in tile City of Lakewood in the fore- <br />seeable future, and it has been further ~eported that the funds raised by the <br />rates charged by the City of Cleveland are being imprudently and unnecessarily <br />applied so that the most pressing problems of repair and expansion are not being <br />solved in this City as well as in other parts of the water system, and <br /> <br /> WHEREAS, due to its demonstrated inability to properly maintain, operate, <br />repair, improve and expend its water supply and distribution system, the City of <br />Cleveland may be unable to adequately cope with the water demands of the residents <br />and other users of water of the City of Lakewood presently or in the foreseeable <br />future to the detriment of the public safety, health and welfare, an& <br /> <br /> WHEREAS, t~e City of Lakewood and its residents will be deprived o~ <br />adequate water service in the future unless immediate and proper action is taken, <br />and <br /> <br /> WHEREAS~ the City of Lakewood and its residents will be deprived of <br />adequate water service in the future unless immediate and proper action is taken, <br />and <br /> <br /> WHEREAS, by reason of the foregoing, the regionalization of the Cleveland <br />Water System is vitally necessary in order to provide and maintain adequate and <br />equitable water service in the future, and <br /> <br /> WHE.REAS, this Resolution constitutes an emergency measure providing for <br />the immediate preservation of the public health, safety and welfare of the residents <br />of this municipality in that unless immediate action is undertaken, the Cleveland <br />Water System will continue to drastically deteriorate and be unable to provide <br />adequate water service to its present and future users; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF TllE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the City of Lakewood shall join with all other affected <br />municipalities enacting similar legislation in all proper action, litigation or <br />otherwise, to determine and enforce its rights and the rights of its residents <br />with regard to water service from the City of Cleveland and the adequacy thereof. <br /> <br /> Section 2. That the City of Lakewood shall join with all other affected <br />municipalities enacting similar legislation in sponsoring engineering, technical <br />studies and legal services for the regionalization of the Cleveland Water System. <br /> <br /> Section 3. That the Water Task Force of th.e County Mayors and City <br />Managers Association is authorized to coordinate, such legal action and/or negotia- <br />tion and to employ such professional assistance, legal, technical or otherwise, as <br />it may deem necessary to carry out the intentions of Sections 1 and 2 of thls <br />Resolution. <br /> <br /> Section 4. That the Clerk is authorized, empowered and directed to <br />certify a copy of this Resolution to the Executive Secretary of the Cuyahoga County <br />Mayors and City Managers Association. <br /> <br /> <br />
