RESOLUTION NO. 5147 BY: Messrs. Chinnock, Mag~otto, McBride, Sa]fmoni Sinagr@, Usher, Brockman AN EMERGENCY i~SOLUTION authorizing the City of Lakewood, Ohio to join with other municipalities in litigation against the City of Cleveland with regard to water service, authorizing the Suburban Water Task Force Committee of the Cuyahoga County Mayors and City Managers Association to Coordinate efforts and receive and expend funds therefor; and declaring an emergency, from the a master WHEREAS, water consumers in the City of Lakeweod receive water service City of Cleveland, either directly or through this suburb by means of meter, and WHEREAS, it bas been reported that the operation of the water filtration, purification and distribution system of the City of C;leveland may be unable to cope with tile requirements of the users of water in tile City of Lakewood in the fore- seeable future, and it has been further ~eported that the funds raised by the rates charged by the City of Cleveland are being imprudently and unnecessarily applied so that the most pressing problems of repair and expansion are not being solved in this City as well as in other parts of the water system, and WHEREAS, due to its demonstrated inability to properly maintain, operate, repair, improve and expend its water supply and distribution system, the City of Cleveland may be unable to adequately cope with the water demands of the residents and other users of water of the City of Lakewood presently or in the foreseeable future to the detriment of the public safety, health and welfare, an& WHEREAS, t~e City of Lakewood and its residents will be deprived o~ adequate water service in the future unless immediate and proper action is taken, and WHEREAS~ the City of Lakewood and its residents will be deprived of adequate water service in the future unless immediate and proper action is taken, and WHEREAS, by reason of the foregoing, the regionalization of the Cleveland Water System is vitally necessary in order to provide and maintain adequate and equitable water service in the future, and WHE.REAS, this Resolution constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare of the residents of this municipality in that unless immediate action is undertaken, the Cleveland Water System will continue to drastically deteriorate and be unable to provide adequate water service to its present and future users; now, therefore, BE IT RESOLVED BY THE COUNCIL OF TllE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the City of Lakewood shall join with all other affected municipalities enacting similar legislation in all proper action, litigation or otherwise, to determine and enforce its rights and the rights of its residents with regard to water service from the City of Cleveland and the adequacy thereof. Section 2. That the City of Lakewood shall join with all other affected municipalities enacting similar legislation in sponsoring engineering, technical studies and legal services for the regionalization of the Cleveland Water System. Section 3. That the Water Task Force of th.e County Mayors and City Managers Association is authorized to coordinate, such legal action and/or negotia- tion and to employ such professional assistance, legal, technical or otherwise, as it may deem necessary to carry out the intentions of Sections 1 and 2 of thls Resolution. Section 4. That the Clerk is authorized, empowered and directed to certify a copy of this Resolution to the Executive Secretary of the Cuyahoga County Mayors and City Managers Association.
