RESOLUTION NO. 5153 BY: <br /> <br />Messrs. Salmon, Sinagra, Usher, <br />BrOckman, Chinnock, Magnotto, McBride <br /> <br /> A RESOLUTION requesting the Cleveland Regional Sewer District to take <br />whatever steps are necessary to expand its statutory purpose under Ohio Revised <br />Code Section 6119.01 to include the supply of water to users within and without <br />the District and to under,take negotiations to assume the responsibility of opera- <br />ting and managing the Regional Water System of the City of Cleveland, and <br />declaring an emergency. <br /> <br /> WHEREAS, the City of Cleveland currently operates a water supply system <br />which has over a number of years been continuously expanded to serve the entire <br />Greater Cleveland area tQ the extent that said system is a regional water system, and <br /> W~EREAS, the City of Lakewood along with other municipalities in the Greater <br /> Cleveland region, has heretofore contracted with the City of Cleveland to have the <br /> City of Cleveland, Division of Water and Heat of the Department of Public Utilities, <br /> provide an adequate supply of water, and <br /> ~EREAS, it has been demonstrated in the past that the operation of muni- <br /> cipally owned utilities which service large metropolitan areas is best handled on <br /> a regional basis and a greater efficiency can be obtained by tbe pooling of resources <br /> and manpower throughout the area serviced, thereby accomplishing improved mainten- <br /> ance, repair and expansion, and <br /> <br /> WHEREAS, it is~recognized that the City of Cleveland has attempted to <br /> provide service but has been unable to do so because of the vast area that the Water <br /> Department services, andi <br /> <br /> WHEREAS, water: revenue receipts collected by the Cleveland Water Depart- <br /> ment are being imprudentily and unnecessarily applied so that the most pressing pro- <br /> blems of repair and expansion in all parts of the system are not being solved, and <br /> WHEREAS, unless proper action is promptly instituted, the condition of <br /> the Cleveland Water System will continue to drastically deteriorate not only as to <br /> the inadequacy of the water pressure and volume being delivered by Cleveland, but <br /> also as to the quality of water to be furnished, and <br /> WHEREAS, the Cleveland Regional Sewer District has demonstrated an ability <br /> to operate, maintain, improve and expand the regional sanitary sewer system, and <br /> WHEREAS, Chapter 6119 of the Ohio Revised Code allows for regional sewer <br /> and water districts by petition to expand its statutory purpose to include the <br /> supply of water to users within and without the district and to assume the opera- <br /> tion of a water supply and distribution system; now, therefore, <br /> BE IT P. ESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council, Administration and Mayor hereby request <br />that the Cleveland Regional Sewer District take whatever immediate steps are <br />necessary to expand the statutory purpose under Ohio Revised Code Section 6119.01 to <br />include the supply of water to users within and without the District and to under- <br />take negotiations to assume the responsibility of operating and managing the <br />regional water system of the City of Cleveland. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized and <br />directed to forward certified copies of this resolution to the Cleveland City Council, <br />all suburban Councils and to the Regional Sewer District. <br /> <br /> Section 3. ~hat this resolution is hereby declared to be an emergency <br />measure in that the same provides for the immediate preservation of the safety and <br />welfare of the City of Lakewood, Ohio, and for the further reason that a real and <br />present emergency exists in that unless immediate action is undertaken, the Cleveland <br />Water System will continue to drastically deteriorate and be unable to provide adequate <br /> water service to its present and future users; wherefor_~_f this resolution shall be in <br /> full force and effect from and immediately after its p~sz~ge~/~ and ap~rov,al/by~heMayor.///~f~ <br /> Ado ted' ~ ~/~ ~~ ~ /f~ <br /> <br /> . ~ Clerk ~ ~..4 <br /> Approved: ~' ~/~ ~ //~a¢'r /~ ~ <br /> <br /> <br />
