RESOLUTION NO. 5154 <br /> <br />BY: Messrs. Sa~lmon, Sinagra~ Usher, <br /> Brockman, Chinnock~ Msgnotto, Mcbride <br /> <br /> AM EMERGENCY RESOLUTION authorizing and directing the Mayor to engage <br />outside special legal counsel and expert electrical engineers and/or other <br />technical experts to assist the City, in connection with the proposed construc- <br />tion of a CEI substation at or near the intersection of Bunts Road and Merl <br />Avenue in the City of Lakewood. ~ <br /> <br /> WHEREAS, th~ Cleveland Electric~Illuminating Company is proposing <br />the construction of a substation on property situated at or near the intersection <br />of Bunts Road and Mert Avenue in the City of Lakewood, and <br /> <br /> WHEREAS, iniview of the fact that it is represented that said substation <br />will serve only the residents of the City of Lakewood, many speqialized lega]. <br />issues have arisen as to the degree of control of the City of Lak~wood over the <br />construction of said substation, and <br /> <br /> WHEREAS, this Council is of the opinion that in order to be properly <br />advised as to what remedies are available to the City of Lakewood, particularly <br />if the matter of the proposed Construction involves court litigation that it <br />would be in the best interest of the City ~to hire special outside legal counsel <br />and expert electrical engineers and/or other technical experts, and <br /> <br /> WHEREAS, this Resolution is hereby declared to be an emergency measure <br />providing for the immediate preservation of the publid health, safety and welfare <br />and for the further reason that the aforementioned expert assistance should be <br />obtained at the earliest possible time; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That the Mayor be and he is hereby authorized and directed <br />to engage outside spelcial legal counsel and expert electrical engineering and/or <br />other technical exper:ts as he shall determine necessary to assist the City in <br />connection with the p!roposed construction of a CEI substation at or near the <br />intersection of Bunts~ Road and Merl Avenue in the City of Lakewood. <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency <br />measure for th~ reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members ~lected to Cooncil, it shall <br />take effect and be in force immediately upon its~option and approval by the <br />Mayor. <br /> <br /> ~ler~/ <br /> <br />Mayor <br /> <br /> <br />
