RESOLUTION NO. 5155 BY: Messrs. McBride~ Salmon, Sinagra, <br /> Usher, Brockman, Chinnock, Magnotto <br /> <br /> AN ~ERGENCY RESOLUTION declaring the necessity and intent of the City of <br />Lakewood to appropriate the rear property located at 17626 Cannon Street in the <br />City of Lakewood, County of Cuyahoga and State of Ohio, owned by Florence E. Mason <br />and bearing Permanent Parcel No. 311-23-53. <br /> <br /> WHEREAS, the real property hereinafter fully described is needed for municipal <br />use for a Public Park and Recreation Area for the City of Lakewood, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for the <br />usual daily operation of a municipal department and for the further reason that <br />this Council determines it to be in the best interest of the City that said <br />property be purchased at the earliest possible time so that a Public Park and <br />Recreation Area can be developed at said location at the earliest possible time; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That this Council hereby determines it necessary and declares <br />it to be the intention of this Council to appropriate the fee simple interest in <br />and to the real property hereinafter described for the purpose of using same for <br />a Public Park and Recreation Area for the City of Lakewood, Ohio: <br /> <br />17626 Cannon Street, Lakewood, Ohio <br /> <br />Owner: Florence E. Mason <br /> <br />Permanent Parcel No. 311-23-53 <br /> <br />Situated in the City of Lakewood, County of Cuyahoga and State of <br />Ohio: and known as Being a part of Sub. Lot No. I in Carlos R. Atwells <br />Subdivision of a part of Original Rockport TOwnship Section No. 23, as <br />shown by the recorded plat of said Subdivision in Volume 8 of Maps, <br />Page 22 of Cuyahoga County Records and bounded and described as follows: <br /> <br />Beginning at a point distant 46 feet Westerly from the Southeasterly <br />corner of Sub. Lot No. 1 in the center line of Cannon Street (now vacated) <br />thence Northerly parallel with the Easterly line of said Sub. Lot No. 1 <br />and the center line of Cannon StreeP (now vacated), 91.08 feet to the <br />Northerly line of said Sub. Lot No. 1; thence Westerly along the North- <br />erly line of said Sub. Lot No. 1, 120 feet to a point; thence Southerly <br />parallel with the Easterly line of said Sub. Lot. No. 1, 91.08 feet to <br />the Southerly line of said Sub. Lot and thence Easterly along the South- <br />erly line of Sub. Lot No. I, 120 feet to the place of beginning. <br /> <br /> Sention 2. That the Clerk of Council be and she is hereby authorized and <br />directed to cause written notice thereof to be given to the owner of~, person in <br />possession of, or person having an interest of record therein, or to his authorized <br />agents and said notice shall be served by a person designated for the purpose by <br />said Clerk of Council and return made in the manner provided by law for the service <br />and return of sun, nons in civil actions. <br /> <br /> Section 3.
