RESOLUTION NO. 5160 BY: Messrs. Magnotto, McBride, Sinagra, Usher, Brockman AN EMERGENCY RESOLUTION authorizing the Director of Public Works to advertise for bids for the necessary repairs to the electrostatic preci- pitator at the Lakewood Incinerator, and to enter into a contract with the lowest and best bidder after approval by Council. WHEREAS, it has been determined that corrosive gasses passing through the ductwork and cooling tower of the electrostatic precipitator have caused scalinq to the degree that this structure is rapidly becoming a safety hazard, and, WHEREAS, the American Air Filter Company, who installed this equipment has ignored all re~uests by the City to make the necessary repairs and such repairs should be made at the earliest possible time, and WHEREAS, this Resolution constitutes an emergency in that it provides for the immediate preservation of the public peace, property, health and safety and provides for the usual daily operation of a municipal department, now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works be, and he is hereby authorized to advertise for bids for the necessary repairs to the ductwork and cooling tower at the electrostatic precipitator at the incinerator, and to enter into a contract with the lowest and best bidder after approval by Council. Section 2~ That funds required for such necessary repair shall be charged to AmeriCan Air Filter Company under its contract with the City. Section 3. That this resolution is hereby declared to be an emergency measure for th~. reasons stated in the preamble hereof~ and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take e~fect and be in force immediately upon its adoption and approval by the Mayo~, Adopted: ~:m~,/+~ P~Jsi Cter~ Approve Mayor
