RESOLUTION NO. 5171 BY: <br /> <br />Messrs. Chinnock, Magno~to, McBride, <br /> Salmon, Sinagra, Usher, <br /> BroCkman <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Law to approve a <br />Journal Entry to enable the "interim" distribution of Local Government <br />funds. <br /> <br />WHEREAS, certain litigation pending in the Supreme Court of Ohio has <br />the effect of preventing distribution of additional unanticipated funds <br />in the 1975 Cuyahoga County Local Government Fund; and other pending <br />litigation has the effect of preventing distribution of the 1976 Local <br />Government Funds; and <br />WHEI{EAS, it is necessary that we have as much of these funds as is possible <br />in order to meet the financial needs of our municipality, and <br />WHEREAS, the Supreme Court of Ohio has indicated that if all or substan- <br />tially all governmental units agree to a Journal Entry in the form attached, <br />a distribution shall be made in accordance therewith, and <br /> WHEREAS, this resolution constitutes an emergency measure .for the immediate <br /> preservation of the public welfare and for the usual daily operation of a <br /> municipal government; now, therefore, <br /> <br /> BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. TRat the Director of Law be and he is, hereby authorized to <br /> approve and to execute on behalf of the City of Imkewood a Journal Entry, <br /> in the form set forth in Exhibit I attached hereto, authorizing an interim <br /> distribution of local government funds. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby authorized and <br /> directed to transmit a.certified copy of this resolution together with the <br /> signed Journal Entry to Mmyor Alan Mills of the Cuyahoga County Mayor's <br /> Association, in care of AMthur P. Lambros, Attorney At Law, 21270 Lorain <br /> Road, Fairview Park, Ohio, 44126. <br /> <br /> Section 3.
