RESOLUTION NQ. 5173 <br /> <br />BY: Messrs. Sinagra, Usher, Brockman, <br /> Chinnock, Magnotto, McBride, Salmon <br /> <br /> AN EMERGENCY PdESOLUTION requesting the Director of Transportation to <br />review the Engineering and Traffic Investigation for the purpose of declaring <br />a reasonable and safe prima-fac~e speed limit for Lakewood Heights Boulevard <br />from its eastern terminus at the municipal boundary line of the City of Lakewood <br />and the City of Cleveland, to its western terminus at Woodward Avenue in the <br />City of Lakewood. <br /> <br /> WHEREAS, tha~ portion of Lakewood Heights Boulevard situated between <br />the municipal boundary line of the City of Lakewood on the east, and extending <br />westward to Woodward Avenue, constitutes an integral artery of the traffic flow <br />pattern through the City of Lakewood, and <br /> <br /> WHEREAS, on November i, 1976 an 8-1/2 mile segment of Interstate 90 <br />opened to traffic, whereby the aforementioned portion of Lakewood Heights <br />Boulevard became the designated truck route and principal roadway for all traffic, <br />both entering and exiting Interstate 90 at its present eastern terminus, and <br /> <br /> kSIEREAS, this Council has caused to he made an Engineering and Traffic <br />Investigation upon the aforesaid portion of Lakewood Heights Boulevard, and <br /> <br /> WHEREAS, this Council has determined, upon the basis of said Engineering <br />and Traffic Investigation, that the prima-facie speed permitted under Seetions <br />4511.01 to 4511.80 and 4511.99 of the Ohio Revised Code on the aforementioned <br />Lakewood Heights BouleVard, to wit, 35 miles per hour, is greater than is reasonable <br />and safe under the conditions found to exist at such location, and <br /> <br /> WHEREAS, thi~ Resolution constitutes an emergency measure providing for <br />the immediate preservation of the put lic health, safety and welfare and for the <br />usual daily operation ef a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Sectio~ 1. Pursuant to the provisions of Section 4511.21 of the Ohio <br />Revised Code, the Director of Transportation is hereby requested to review the <br />Engineering and Traffic Investigation and to determine and declare a reasonable <br />and safe prima-facie speed limit, to wit, twenty-five (25) miles per hour, for <br />Lakewood Heights Boulevard from its eastern terminus at the municipal boundary <br />line of the City of Lakewood and the City of Cleveland to its western terminus <br />at Woodward Avenue in the City of Lakewood. <br /> <br /> Section 2. That upon notification by the Director of Transportation <br />that the prima-faeie speed limit has been altered, this Council acknowledges <br />that such altered speed limit shall become effective only when appropriate signs <br />giving notice thereof are erected at such location. <br /> <br /> Section 3. That the Clerk of Council is hereby authorized and directed <br />to forward a certified~ copy of this Resolution, together with a copy of the City's <br />Engineering and Traffic Investigation, to the Director of Transportation of the <br />State of Ohio. <br /> <br /> Section 4. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect 'and be in force immediately upon its adoption~d approval by the Mayor. <br />Adopted: ~ /~ /~ ,"~/~,~ ,0 ~J~/~ <br /> <br /> Cler~ <br /> <br /> <br />
