RESOLUTION NQ. 5173 BY: Messrs. Sinagra, Usher, Brockman, Chinnock, Magnotto, McBride, Salmon AN EMERGENCY PdESOLUTION requesting the Director of Transportation to review the Engineering and Traffic Investigation for the purpose of declaring a reasonable and safe prima-fac~e speed limit for Lakewood Heights Boulevard from its eastern terminus at the municipal boundary line of the City of Lakewood and the City of Cleveland, to its western terminus at Woodward Avenue in the City of Lakewood. WHEREAS, tha~ portion of Lakewood Heights Boulevard situated between the municipal boundary line of the City of Lakewood on the east, and extending westward to Woodward Avenue, constitutes an integral artery of the traffic flow pattern through the City of Lakewood, and WHEREAS, on November i, 1976 an 8-1/2 mile segment of Interstate 90 opened to traffic, whereby the aforementioned portion of Lakewood Heights Boulevard became the designated truck route and principal roadway for all traffic, both entering and exiting Interstate 90 at its present eastern terminus, and kSIEREAS, this Council has caused to he made an Engineering and Traffic Investigation upon the aforesaid portion of Lakewood Heights Boulevard, and WHEREAS, this Council has determined, upon the basis of said Engineering and Traffic Investigation, that the prima-facie speed permitted under Seetions 4511.01 to 4511.80 and 4511.99 of the Ohio Revised Code on the aforementioned Lakewood Heights BouleVard, to wit, 35 miles per hour, is greater than is reasonable and safe under the conditions found to exist at such location, and WHEREAS, thi~ Resolution constitutes an emergency measure providing for the immediate preservation of the put lic health, safety and welfare and for the usual daily operation ef a municipal department; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Sectio~ 1. Pursuant to the provisions of Section 4511.21 of the Ohio Revised Code, the Director of Transportation is hereby requested to review the Engineering and Traffic Investigation and to determine and declare a reasonable and safe prima-facie speed limit, to wit, twenty-five (25) miles per hour, for Lakewood Heights Boulevard from its eastern terminus at the municipal boundary line of the City of Lakewood and the City of Cleveland to its western terminus at Woodward Avenue in the City of Lakewood. Section 2. That upon notification by the Director of Transportation that the prima-faeie speed limit has been altered, this Council acknowledges that such altered speed limit shall become effective only when appropriate signs giving notice thereof are erected at such location. Section 3. That the Clerk of Council is hereby authorized and directed to forward a certified~ copy of this Resolution, together with a copy of the City's Engineering and Traffic Investigation, to the Director of Transportation of the State of Ohio. Section 4. That this Resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect 'and be in force immediately upon its adoption~d approval by the Mayor.
