RESOLUTION NO. 5223 BY: <br /> <br />Messrs. Chinnock, Magnot~,~%~i <br />Salmon, Usher, Brockman <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Law of the City of <br />Lakewood to institute an action in the Common Pleas Court of Cuyahoga County, Ohio <br />to declare the premises at 15608 Lake Avenue, Lakewood, Ohio to be a public nuisance, <br />to enjoin the same and to seek such other and further relief as the Court may deem <br />proper. <br /> <br /> WHEREAS, the Departments of Health, Fire and Building of the City of <br />Lakewood have determined, after a thorough inspection, that the premises located <br />at 15608 Lake Avenue, Lakewood, Ohio are in violation of the Building and Health <br />Code of the City and are a fire and safety hazard, not only to the occupant of the <br />premises but to the surrounding neighborhood, and that said premises are a public <br />nuisance, and <br /> <br /> WHEREAS, previous attempts by officials of the City to abate such nuisance <br />and to require the occupant of said premises to comply with the codes of the City <br />have been to no avail, and <br /> <br /> WHEREAS, this Council deems it of utmost importance to the City of Lakewood <br />that said premises be brought into compliance with all City codes, and <br /> <br /> WHEREAS, this Resolution constitutes an emergency measure providing for <br />the immediate preservation of the public safety, health and welfare in that immediate <br />steps should be taken to abate an existing public nuisance and provides for the <br />usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF I~tKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Law of the City of Lakewood be and he is <br />hereby authorized to prepare and file a complaint in the Common Pleas Court of <br />Cuyahoga County, Ohio declaring the premises at 15608 Lake Avenue, Lakewood, Ohio <br />to be a public nuisance, to seek a temporary and permanent injunction against the <br />owner and/or occupant of said premises from maintaining a public nuisance and from <br />failing and/or refusing to comply with the directives of the City of Lakewood and <br />for such other and further orders and relief as the Court may deem appropriate, <br />just and equitable with respect to said premises. <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force immediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: <br /> <br />Clerk <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
