RESOLUTION NO.: 5228

BY:

Messrs. Magnotto, McBride, Salmon,
Sinagra, Usher, Brockman, Chinnock

AN EMERGENCY RESOLUTION authorizing and directing the Director
of Public Works to enter into contract for the purchase and installation
of one 12,000 gallon underground fuel storage tank at the Refuse Division,
12920 Berea Road, with the lowest and best bidder after advertisement
according to law.

WHEREAS, this Resolution constitutes an emergency measure provid-
ing for the usual daily operation of a municipal department, and for the
immediate preservation of the public health, safety, and welfare, and,

WHEREAS, in 1976 it was necessary to repair this tank and the
corroded piping because of underground water contamination, and,

WHEREAS, presently we are experiencing contamination from scale
and rust, and sandblasting and relining would cost approximately $4,000.00,
and,

WHEREAS, the present tank is over 30 years old, and it is doubtful
that these repairs would completely cure the problem, and,

WHEREAS, this Council has determined that it is in the best interest
of the City to replace this tank rather than attempt repairs, now, therefore,

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF

OHIO:

Section 1. That the Director of Public Works is hereby authorized
and directed to enter into a contract for the purchase and installation of
a 12,000 gallon underground fuel storage tank at the Division of Refuse,
for an estimated amount of $13,800.0~ with the lowest and best bidder after
advertisement according to law.

Adopted

Section 2. That this Resolution is hereby declared to be an
emergency measure for the reasons stated in the preamble hereof and provided
it receives the affirmative vote of two-thirds of all members elected to
Council, it shall be deemed to be in effect upon its adoption and approval
by the Mayor.

Approved: ~.~ ~//.~.7x~

Mayor
