RESOLUTION NO. 5229 BY: <br /> <br />Messrs. Salmon, Sinagra, Usher, <br />Brockman, Chinnock, Magnotto, McBride <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Works to <br />enter into a change order contract with American Air Filter Co. to repair the <br />cooling tower and associated duct work at the municipal incinerator in an amount <br />not to exceed Fifty One Thousand Dollars ($51,000.00). <br /> <br /> WHEREAS, the City of Lakewood has experienced severe corrosion conditions <br />in the cooling tower and associated duct work portions of the fume control equip- <br />ment at the municipal incinerator, and <br /> <br /> WHEREAS, such conditions require the immediate repair and replacement <br />of the cooling tower and associated duct work, and <br /> <br /> WHEREAS, American Air Filter Co., the original fabricator and installer <br />of such equipment, has agreed after lengthy negotiations that it will furnish all <br />labor and material necessary to repair the corroded portions of such equipment for <br />a price not to exceed Fifty One Thousand Dollars ($51,000.00), and <br /> <br /> WHEREAS, a real and present emergency exists in the usual daily operation <br />of a municipal department in that the corroded conditions existing in the municipal <br />incinerator are extensive and serious, necessitating immediate repair, and for the <br />further reason that it is necessary to enter into a contract without delay in order <br />to insure the continued operation of the municipal incinerator to provide for the <br />preservation of the public health, safety and welfare; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section t. That the Director of Public Works be and he is hereby <br />authorized and directed to enter into a contract with American Air Filter Co. to <br />provide all labor and material necessary to repair the corroded portions of the <br />cooling tower and associated duct work at the municipal incinerator in an amount <br />not to exceed Fifty One Thousand Dollars ($51,000.00). <br /> <br /> Section 2. That this Resolution is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption and approval by the <br />Mayor; otherwise it shall take effect and be in force from and after the earliest <br />period allowed by law. <br /> <br />Ad°pted:~~z~//~· ~ <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
