RESOLUTION NO. 5235

<br /> AN EMERGENCY RESOLUTION authorizing thei~Director of Public Works
<br />to enter into a change order addition to e~isting contracts with National
<br />Plumbing Company and Wilson Bennett, Incorporated to fabricate and install
<br />a pool water supply distribution Piping system and a new hot water boiler
<br />at Foster Pool in an amount not to exceed $53,000 for Wilson Bennett,
<br />Incorporated and in an amount not to exceed $5,000 for National Plumbing
<br />Company.
<br />
<br /> WHEREAS, during'the construction of the air structure over Foster
<br />Pool~ investigation has revealed that the existing water supply distribution
<br />piping system to the pool is completely deteriorated and requires replace-
<br />ment prior to operation of the pool, and,
<br />
<br /> WHEREAS, during the construction of the air structure at Foster
<br />Pool, investigation has revealed the existing hot water boiler is completely
<br />deteriorated, beyond repair, and requires replacement and,
<br />
<br /> WHEREAS, these items constitute pool rehabilitation work and not
<br />new construction for the erection of an air structure, and,
<br />
<br /> WHEREAS, any further delay in the rehabilitation of the existing
<br />pool will result in extreme hardship to the city, and,
<br />
<br /> WHEREAS, the amounts quoted for this work by National Plumbing
<br />Company and Wilson Bennett, Incorporated are fair market value, and,
<br />
<br /> WHEREAS, National Plumbing Company and Wilson Bennett, Incorpor-
<br />ated are most familiar with the construction of the pool, because they are
<br />prime contractors for the installation of an air structQre over the pool,
<br />and,
<br />
<br /> WHEREAS, pursuant to Ohio Revised Code 735.051, the legislative
<br />authority of a municipal corporation may, by a two-thirds vote, contract
<br />for the purchase of construction work without formal bidding and advertising
<br />in the case of a real emergency arising in connection with the operation and
<br />maintenance of the Department of Public Works, and,
<br />
<br /> WHEREAS, a real and present emergency exists in the usual operation
<br />of Foster Pool in that the existing water supply distribution piping System
<br />and the hot water boiler need to be replaced at the earliest opportunity and
<br />it is necessary to'enter into a contract immediately in order to insure
<br />Foster Pool.is operable for the winter months to provide for the preservation
<br />of the public health, safety and welfare; now, therefore,
<br />
<br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section l: That the Director of Public Works is hereby authorized
<br />and directed to enter into a change order addition to present contracts with
<br />National Plumbing Company and Wilson Bennett, Incorporated to provide all
<br />necessary labor and material to install a new water supply distribution piping
<br />system and a new hot water boiler at Foster Pool in an amount not to exceed
<br />$58,000.
<br />
<br /> Section 2. The funding for this work shall be provided by the
<br />Swimming Pool Account of the General Fund.
<br />
<br /> Section 3. That this resolution is hereby declared to be an emer-
<br />gency measure for the reasons stated in the preamble hereof and provided it
<br />receives the affirmative vote of two-thirds of all members elected to Council,
<br />it shall take effect and be in force immediately upon its adoption and approval
<br />
<br />by the Mayor.
