RESOLUTION NO. 5238 BY: <br /> <br />Messrs. Chinnock, Magnotto, <br />McBride, Salmon, Sinagra, <br />Brockman <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Mayor to make <br />application to the Cuyahoga County Board of Commissioners for approval to <br />use Cuyahoga County Motor Vehicle $5.00 license tax funds for participation <br />with the County in the improvement of Hilliard Boulevard and Franklin <br />Boulevard from Riverside Drive to West 117th Street by increasing the <br />structural adequacy of pavement by resurfacing with asphaltic concrete <br />including the necessary replacement and resetting Of castings and the <br />necessary resetting and replacing of curbs including ramps for the handi- <br />capped together with necessary appurtenances thereto. <br /> <br /> WHEREAS, this Council by two-thirds vote of the members elected thereto <br />determines that this Resolution is an emergency measure which is necessary <br />for the immediate preservation of the public peace, property, health and <br />safety and for the further reason that the improvements herein provided <br />are immediately necessary to eliminate existing hazards to vehicular traffic <br />using the streets of the City; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Lakewood, <br />Cuyahoga County, State of Ohio. <br /> <br /> Section 1. That it is necessary to improve Hilliard Boulevard and <br />Franklin Boulevard from Riverside Drive to West 117th Street, that the Mayor <br />be and he is hereby authorized and directed to make application to the <br />Cuyahoga County Board of Commissioners for approval to use Cuyahoga County <br />Motor Vehicle $5.00 license tax'funds for participation with the County in <br />the improvement of Hilliard Boulevard and Franklin BOulevard from Riverside <br />Drive to West 117th Street by increasing the structural adequacy of pavement <br />by resurfacing with asphaltic concrete including the necessary replacement <br />and resetting of castings and resetting and replacing the curbs including <br />ramps for the handicapped together with the necessary appurtenances thereto. <br /> <br /> Section 2. The Clerk of Council be and she is hereby directed to <br />transmit copies of the application together with a certified copy of this <br />Resolution to the Cuyahoga County Board of Commissioners and to the <br />Cuyahoga County Engineer. <br /> <br /> Section 3. This Resolution is hereby declared to be an emergency <br />measure necessary to protect the public health, safety and welfare and for <br />the further reason that said funds are necessary to expedite the Hilliard <br />Boulevard and Franklin Boulevard ~vom Riverside Drive to West 117th Street <br />project, and shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; Otherwise from and after the earliest period <br /> <br />allowed by law. <br /> <br />Adopted: b/~..~_4.t2 <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
