RESOLUTION NO. 5252 BY: Messrs. Magnotto, McBride, Salmon, <br /> Sinagra, Usher, Brockman, Chinnock <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Director of Public Safety <br />to enter into a contract for the purchase of a motor vehicle for the Department <br />of Public Safety - Division of Police without formal bidding and advertising. <br /> <br /> WHEREAS, on November 1, 1977 a police cruiser of the City was <br />damaged in a motor vehicle accident to the extent that cost of repair exceeds <br />the value of the car and also to such an extent that same is no lOnger fit <br />for police service, and <br /> <br /> WHEREAS, it is essential to the safety and welfare of the citizens <br />of Lakewood that the number of police vehicles available for service be <br />maintained, and <br /> <br /> WHEREAS, pursuant to Ohio Revised Code 735.051, the legislative <br />authority of a municipality, by a two-thirds vote, may authorize the Director <br />of Public Safety to enter into a contract for the purchase of equipment <br />without formal bidding and advertising in the case of a real and present <br />emergency arising in connection with the operation and maintenance of the <br />Department of Public Safety, and <br /> <br /> WHEREAS, a real and present emergency exists in the Department <br />of Public Safety in that the number of police vehicles serving the City must <br />be maintained for the immediate preservation for the public safety and welfare <br />and a replacement police cruiser should be obtained immediately and without <br />undue delay; now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Safety be and he is hereby <br />authorized and directed to enter into a contract for the purchase of a motor <br />vehicle for the Department of Public Safety - Division of Police without formal <br />bidding and advertising. <br /> <br /> Section 2. That the funds required for the purchase of said motor <br />vehicle shall be appropriated from the Federal Revenue Sharing Fund - Equipment <br />Account. <br /> <br />the earliest period allowed by law. <br /> <br />Adopted:.~~ ~/f~7 <br /> <br /> Section 3. That this Resolution is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives the affirmative vote of two-thirds of all members elected to Council, <br />it shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise it shall take effect and be in force from and after <br /> <br />Approved: <br /> <br />Mayor <br /> <br /> <br />
