RESOLUTION NO. 5281 BY: Messrs. Magnotto, McBride, <br /> Salmon, Usher, Brown, Chinnock <br /> <br />A RESOLUTION expressing the intent of the City of Lakewood to cooperate with <br />the Commissioners of Cuyahoga County concerning municipal solid waste d~isposa%~ <br /> <br />WHEREAS, the Commissioners of Cuyahoga County, Ohio, have indicated an f~tention <br />to ac~ as the prime sponsor of a resource recovery facility which would~ use, ~as~ <br />its raw materials, the solid waste generted in and by the City of Lakewood~Rnd~'' <br />in other municipalities in Cuyahoga County, Ohio, and ~ u nu~,: <br /> <br />WHEREAS, the creation of such a facility will require extensive technoto'gical~*~it~. <br />legal, financial and other planning by the County for the benefit of the County <br />and participating municipalities, and <br /> <br /> WHEREAS, the feasibility of creating and operating such a facility will dep~n~,~ u~ <br /> on the long-term commitment of the municipalities within Cuyahoga County <br /> deliver adequate amounts of processable solid waste to such a facility and'~. ~,~n <br /> paYing an adequate and equitable fee for processing such solid waste~and,. ~. ~x~ <br /> <br />WHEREAS, the Commissioners of CuyahOga County require formal expressions of <br />interest by those municipalities who wish to consider long-term contractS, so <br />that the Commissioners might determine the feasibility of such a project before, <br />committing themselves to extensive planning costs or contractual obligations; <br />now, therefore, <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF!OHIO: <br /> <br />Section 1. That the City of Lakewood hereby expresses an interest in c~onside~ring <br />a Contract of at least twenty years' duration for the delivery of all.the solid <br />waste collected by the City or its contractee, now estimated to be at least <br />one ~u~dred thirty(130) tons per day, according to a fee schedule to.be: <br />determined in the future, which fee schedule would permit the timely retirement <br />of indebtedness and payment of ooerating costs arising from this project. <br /> <br />Section 2. That this Council hereby authorizes the Administration to enter into <br />discussions with representatives of Cuyahoga County, Ohio, leading to an agreement <br />subject to approval of Council by ordinance, to be entered into between this <br />City and Cuyahoga County, Ohio gnd/or its designee, which agreement shall (a) <br />provid'e for the disposal of all of this City's solid waste, (b) provide for the <br />payment of the City's service fees required in connection therewith, (c) be in <br />operation for a duration beginning with the date of its execution and ending on <br />the date to be set for the retirement of the indebtedness arising from this <br />project, (d) provide a formula for service fees which takes into acco,nt ~he <br />debt service and operating costs arising from the project, and (e) be conditioned <br />upon the substantial completion of the project so that it is able to receive <br />solid waste for processing. <br /> <br />Section 3. That the City of Lakewood acknowledges that the Commissioners of ~ <br />Cuyahoga County, Ohio, will use this expression of interest to help them determine <br />the feasibility of the contemplated solid waste recovery and processing project. <br /> <br />Section 4. That this resolution shall take effect immediately upon its adoption <br />and shall remain effective until agreement of the kind described above is entered <br />into, or to December 31, 1978, whichever event shall first occur. <br /> <br />Adopted: ~/~t/ ~ /~/~ <br /> <br />Approved: <br /> <br /> <br />
