RESOLUTION NO.: 5290 BY:Messrs. McBride, Salmon, Usher, Brockman, Brown, Magnotto AN ~]~RGENCY RESOLUTION authorizing the City Engineer to enter into a change order addition to an existing contract with Doan Electric Company to increase the size of the generator for the Senior Center to 150-KW size in an amount not to exceed $38,580. WHEREAS, the January blizzard demonstrated the need for the Senior Center as an emergency station f~r temporarily displaced persons, and, WHEREAS, with the intent of increasing the viability of the Center as an emergency station the generator must be increased in capacity to 150-KW size, and, WHEREAS, pursuant to Ohio Revised Code 735.051 the legislative authority of a Municipal Corporation may, by a two-thirds vote, contract for the purchase of construction work without formal bidding and advertising in the case of a real emergency arising in connection with the operation and maintenance of the Senior Center, and, WHEREAS, a real and present emergency exists in that the installation of a larger generator is necessary for the safety and welfare of those who live in and use the Senior Center; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the City Engineer is hereby authorized and directed to enter into a change order addition to the present contract with Doan Electric Company to increase the size of the generator to 150-KW size not to exceed $38,580. Section 2. That this resolution is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all me~ers elected to Council ~t shall take effect and be in force immediately upon ~ts adoption and approval by the Mayor; otherwise at the earliest period as provided by law.
