RESOLUTION NO. 5297 BY:Messrs. McBride, Salmon, Usher, Brockman, Brown, Chinnock, Magnotto AN EMERGENCY RESOLUTION decJarlng it necessary to ]mDrove Elbur Avenue in the CJ ky of Lakewood by the necessary gradinq of the base, re- surfaclnq wlt]] asp]iai tlc concrete including the necessary replacement and resetting of castings and the necessary resetting and replacing of curbs together with necessary appurtenances thereto. WItEPJ~AS, this Council by two-thirds vote of the members elected thereto determines that this resolution is an emergency measure which is necessary for tile immediate preservation of the public peace, property, health and safety and for the further reason that the lmporvemcnts herein provided are immediately necessary to eliminate existing hazards to vehicular traffic using the streets of this City; NOW, ' I;;REFORE, BE IT RESOLVED by the Council of the CJky of Lakewood, Cuyahoga Ceunky, State of Ohio, three-fourths of all members elected thereto concurring: Sect]on 1. That it ls necessary to improve in the City of Lakewood Elbur Avenue from Madison Avenue to Lakewood Hts. Blvd. as set forth in Section 2 hereof. Sect]on 2. That said street shall be improved as shown on the plans hereinafter referred to and now on file in the off[ce of the Department of Public Works by the necessary grading of the base, resurfacing with asphaltic concrete including the necessary replacement and resettl, ng of castll]gs and resetting and replacing the curbs together with the necessary appurtenances thereto. Section 3. It ms hereby determined and declared that sa~d improve- ment ~s conducive to the public health, convenzence and welfare of said City and the inhabitants thereof. Section 4. TIlat t:he grade of said street as unproved shall be the grade as ~hown by the plans and profiles which are made a part hereof. of the Director of Public Works, are hereby approved. Section 6. That not more than 50% of the whole cost of said improve- ment shall be assessed by the benefits upon the following described lots and lands, to wit: AIl ]()ts and land bounding and abutting upon the proposed unprove- ment between tile termini aforesaid, which said lots and lands are hereby determined to be specially benefited by sa~d improvement; and the cost of said improvemeut shall Include the cost of preliminary and other surveys, plans, specifications, profiles and estimates and of printing, serving and publish- lng notices, resolutions arid ordinances, the amount of damages resulting from the improvement assessed iii favor of any owner of ]and sffected by the improve- ment and the Interest thereon, the costs incurred in connection with the pre- paratlon, levy and collection of the special assessments, the cost of purchasing, appropriating, and otherwise acquiring therefor any required rea]. estate or legal opinion, cost of labor and material and ~nterest on bonds and notes issued in anti(]parsee of the levy and collection of the specla] assessments together with all other necessary expenditures. lllc. c (:d (.o telivu- a certified copy of tills resolution to the Director of Finance of this City.
