RESOLUTION NO. 5336 <br /> <br />By: <br /> <br />Wendllng, Brockman, Brown, Chinnock, <br />Magnotto, McBride; SalmOn <br /> <br /> AN EMERGENCY RESOLUTION requesting the permission of the Bureau <br />of Inspection and Supervision of Public Offices to establish a special fund <br />to be known as the City of Lakewood, Ohio, Street Resurfactng Special Asses- <br />sment Rotary Fund. <br /> <br /> WHEREAS, this City follows the statutory procedure in connection <br />with the establishment and maintenance of the various funds of this City, <br />and Section 5705.12, Ohio Revised Code, requires the approval of the Bureau <br />of Inspection and Supervision of Public Offices in order to establish a <br />special fund; and <br /> <br /> WHEREAS~ this City desires to establish a special fund to be <br />known as the Street Resurfacing Special Asseessment Rotary Fund; and <br /> <br /> WHEREAS, this Council by two-thirds vote of the members elected <br />thereto determines that this resolution is an emergency measure which is <br />necessary for the immediate preservation of the public peace~ property, <br />health and safety and for the further reason that immediate provision <br />must be made for the financing of the 1978 Street Resurfacing Program in <br />order to eliminate egisting hazards to pedestrian and vehicular traffic; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Lakewood~ CoUnty of Cuyahoga and State 0f Ohio: <br /> <br /> Section 1. That the City of Lakewood hereby requests the ap- <br />proval of the Bureau of Inspection and SupervisiOn of Public Offices as <br />required by Section 5705.12, Ohio Revised Code, to establish a special <br />fund to be known as the City of Lakewood, Ohio, Street Resurfacing Special <br />Assessment Rotary Fund by the passage of the ordinance attached hereto and <br />marked "Exhibit A". <br /> <br /> Section 2. That the City of Lakewood, Ohio, Street Resurfacing <br />Special Assessment Rotary Fund shall be established for the purposes and <br />shall receive and disburse funds all as described in the ordinance attached <br />hereto and~arked as "Exhibit A". <br /> <br /> Section 3. That it is found and determined that all formal ac- <br />tions of this Council concerning and relating to the adoption of this resolu- <br />tion were adopted in an open meeting of this Council, and that all deliberations <br />of this Council and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance with all legal <br />requirements including Section 121.22, Ohio Revised Code. <br /> <br /> Section 4, That this resolution, having been declared to be an <br />emergency measure, shall be in full fOrce and effect immediately after its <br />adoption and approval by the Mayor. <br /> <br />Adopted: , 1978 <br />Aproved: ~c~ ~-~ , 1978 <br /> <br />-- I ./'9 /// <br /> Clerk ~ CoUncil <br /> <br /> <br />
